Hey,

I applied for my social security number about 8 weeks ago. I got a letter through the post yesterday saying that they couldn't process my social security number the problem is my I-94 expired the day before. I think the reason it couldn't be processed it a clerical error by them placing my middle names as my first name.

I've just been to the social security office for the third time. They said there's nothing they can do because my I-94 has expired now. I need to update it or get a new one. How do I do this? Can I do it online?

Also I haven't sent for my change of status yet. My wife keeps telling me that we need to get a social security number before I send this off. If we file for it now we need to file for it a second time when I get the social security number? Is this true? I'm nervous because, although we married well within the 90 days, my I-94 has expired so I'm kind of floating in limbo.

No, you can sent off your AoS package without your SSN. After you got at least your EAD, you can go back to SSA office and apply for SSN.

To apply for a SSN you MUST go to your local office in person.

And no, having a SSN is not a requirement for AOS.

Now that you're married you can send your AOS to USCIS and where it asks for SSN (if any) you can leave that blank. The only important thing was to get married within 90 upon arrival, which you did, so no point in worrying.

You asked how to renew your I-94. A K1 can't. It is all over after 90 days. You were only eligible to get a SSN based on the K1 visa during that 90 days, and they actually cut it off 2 weeks before. Your next chance will be when you get your EAD card that gives you permission to work. You can also get a SSN based on having a greencard.

Apply for your AOS/EAD/AP as soon as possible leaving the SSN blank.

All K1s go through a limbo after the I-94 expires while they wait for their next document showing they are allowed to be in the US. You can stay while you wait on your adjustment of status, but there isn't anything with a date to prove it. Most states won't give you a driver license either during this limbo.
