I am currently filing my 2nd k1 petition. My previous petition was aborted from 6 years ago.

This is pertaining to a current filing and I just received a letter of RFE July 2014.

The document contains 2 RFE

First is titled 'Marriage Terminations':

Submit proof of the legal termination of the marriage(s) <Name of beneficiary of previous K1 filing>

My first K1 filing was aborted. I am still single and never married. How do I submit an evidence of marriage termination when I was never married and certainly did not marry the beneficiary named on the RFE?

Do I still have to show evidence of the beneficiary's marriage termination if there was ever one? I have lost contact with her 6 years ago.

Should I assume this is a clerical error? I have already contacted the new beneficiary (my fiancé) to send me a non-marriage certificate just in case.

The 2nd RFE is a statement of intent to marry from the beneficiary. I have asked for that as well.

July 29 I emailed SLEC to confirm again when did they forwarded my Medical Result at USEM. They replied...forwarded April 13.
July 30 status update date change FINALLY.
September 2015 went in US embassy to withdraw my passport coz I've waited for how many months and no approval yet. Only to find out my case file has been sitting in the corner ...no one reviewed my medical result. to make the story short, I took medical again for the second time , then after a my medical result released, I have my visa on my hands.

November 7, 2015 SSN
December 2015... 10 year green card arrived
December 2015 Driver's license issued..yay! <p>

Thank you for the timely response.

However I cannot locate the proper place online where I can get this certificate for U.S. Citizens.

All the immediate links are for the Philippines. Although I am a Filipino American and my fiancé is Filipino, where can I get this no marriage certificate for U.S. Citizen?

It is either a clerical error on their part or there is an error in your documentation. Review your copies of all your petition forms and make sure that you did not unintentionally enter a name in one of the previous spouse lines. Their response makes me believe that there is something in your petition that suggests the beneficiary was previously married.

I am reviewing my petition. We both indicated we are single. I did not write anything on previous spouses. We both input 'none' for both current and former spouses on our G-325A.

Is it possible they think I married the beneficiary from my first K1 petition?

I called USCIS and they suggested to make an appointment with the local USCIS offices but unfortunately the website says that there are no appointments available.

Only other option is to get an attorney.

I think NSO has a website that you can do the online application anf send it to you in US...the payment is using your credit card. Certification of no marriage is the only paper that can prove that you were never been married

I went ahead and applied. But you cannot send to a U.S. address. Only to the Philippines. But it would be great if this system can expand to the rest of the world.

you can certainly write up a letter of attestation, fully explaining what's what with the first one, giving dates and process , and submit it in with the RFE, along with any evidence you have of termination of engagement. [even if a letter or email] .

A lawyer would prep the same.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

It sounds like they assumed that you married your first K-1 fiancee.

If you are the US Citizen, don't waste money on any "certificates". There is no such thing as a Single certificate for USC. All they can send you is a sworn affidavit which is not a legal document. Anybody can lie and say they are single.

All you need to do is write a detailed letter and enclose it with your RFE. Basically, explain that it didn't work out with your former fiancee, give details as to what happened, reason(s) why you didn't marry, and dates that she arrived and left (if she left). I would also add that you terminated contact with her at that time.
