Consular interview Monday...no time for panic, but...

I think I've figured this out by reading the above forms discussion, but just to be safe....

My fiancé is in Manila and her interview is monday. I Skyped with her last night and she asked me to fax over my certified divorce decree, along with evidence of relationship, airplane tickets, etc.

I told her I know I had sent them, but didn't remember which packet they went with. Today, after reading the instructions for K-1 form 129F, I realized that this was the packet that all the relationship documentary evidence would be in. So hopefully, this is just a case of nerves on her part, maybe it's the coffee thats got me on edge

If I am correct, the embassy already has all this evidence in my 129F packet ?

Thanks,

Rob187

Yes the embassy has the I-129F original file. BUT.... BIG BUTT!!!! BUT you have to present at the interview EVERYTHING that is listed in the embassy instructions letter. Stuff you sent with the I-129F does NOT get moved to the visa application file.... so SEND IT!

That's right!

IMO, she doesn't need to bring a copy of the I-129f itself. But she does have to know what you have written there especially on the "how you met" part. COs tend to be tricky when there is inconsistency with your I-129f info and her responses to the questions during the interview.

And YES, on the evidences of relationship, such as pictures and recent chat or call logs. Definitely, she also must have a copy of your certified divorce decree. This goes under item i of the embassy instructions: http://photos.state.gov/libraries/manila/325288/packets/K1%20and%20K2%20Interview%20Preparation%20Instructions%20-%20English%20_updated%2004%20Feb%202014_.pdf

i. PROOF OF TERMINATION OF A PRIOR MARRIAGE. If applicable, official documents (divorce
decree, annulment decree or death certificate, etc.) that prove all prior marriages contracted by you and the
petitioner have been legally terminated prior to the filing of the petition must be submitted.

All the best to the interview!

We've sent stuff that never ended up in official files so if they ask you better have it.

At our adjustment of status interview for example we had an extra certified copy of our marriage certificate with us, and it is a good thing we had that with us.

Yes.

But just as a precaution bring copies to the interview.

Good luck.

Thanks Apple21,

I understand the need for caution, but If the answer is yes, wouldn't the 129F already be reviewed, or in review, by USCIS or NVC prior to the interview ? My documentation was detailed and triple checked.

Your feedback was and is appreciated,

Rob

USCIS reviewed your initial packet hence the approval. I think NVC doesn't review it at all because your file didn't stay long with them and as far as I know all they do for K1 filers is issue the case numbers. The embassy will do the final review during the interview and will ask for more evidence as the consul sees fit.

You are missing the point. These are two separate events, each with their own requirements that need to be met. Just because you sent something to one agency does not fulfill the requirements of the other agency. This is NOT the time to try to reinvent the wheel. Very simply email your fiancee copies of these items or expect delays. (221g type delays)

decree, annulment decree or death certificate, etc.) that prove all prior marriages contracted by you and the
petitioner have been legally terminated prior to the filing of the petition must be submitted.
h. EVIDENCE OF A GENUINE ENGAGEMENT. You must be prepared to prove to the consular officer
that you have a genuine relationship with your petitioner and a clear intention to marry within 90 days of
admission into the U.S. In the past, successful applicants have submitted photographs, letters, e-mails,
phone records, bank records, and remittance records as evidence supporting their relationships and intent to
marry.
Plus CFO will want to see a copy of the divorce decree. ;)

I just read the Embassy interview instructions, and all the applicant, my fiancés, instructions which she has in hand and are up to date.

"that prove all prior marriages contracted by you and the petitioner have been legally terminated prior to the filing of the petition"

Both certified copy's of divorce (divorced twice) were filed my me, she has a copy of one certification of termination the last, that passed CFO muster, but I will send the other proof and evidence of genuine engagement...

Whew! Had I not asked the question ....

Thanks, Ron187

Good idea. The embassy does review the petition file so they will be looking for two divorce decrees for you.

Just finished sending off all the documentation and back-up papers....So thanks to all ! I don't want to think that having come this far, to get a interview rejection. Again you all have my most profound respect....

Also credit to both fiancé and me for listening to each other....'we a team' :star:
