We have a question my VJ family may be able to help me with.

I am planning on visiting the Philippines with my Pinay wife for 5 months this Oct-Mar (currently in planning stages)

and need this question answered prior to buying the round trip tickets

My question is this

I am looking at round trip tickets for us both: Depart USA in Oct and Return In Mar (5 months) (Cheapo Air) Korean Airlines

We plan on her requesting a Balikbayan visa upon arrival for me to stay up to 1 year free

Will they sell me a plane ticket that does not show I am leaving Philippines before the 30 day allowance?

Or could they sell me the ticket and then deny me to board the plane at departure time?

Will I need a throw away ticket?

I figure 5 months will give me a very good idea if i can live there long term and at the same time not mess my wife's 10 yr green card application next year

We can apply for ROC in Aug 2015

Any info anyone can give will be greatly appreciated

Purchasing the ticket should be no issue (airlines don't really do the checking at purchase time). Unlikely that they will deny you boarding. You can be more prepared by bringing some proof her being a former national and proof of your marriage. HTH

This is the relevant section of the visa requirements (emphasis mine, taken from the same database the airlines uses):

US nationals to PH:

Visa required, except for A max. stay of one year for former

nationals of the Philippines (Balikbayans) holding proof of

former Filipino nationality.

Visa required, except for A max. stay of one year for

accompanying spouses and children of nationals of the

Philippines who have been outside the Philippines for more

than one year or former nationals of the Philippimes

So Korean Air will allow me to board even if my round trip shows I will not depart Philippines for 5 months?

She is a Philippine national traveling on her Philippine passport

I know she can request Balikbayan for me ONCE we ARRIVE in PI but wasn't sure Korean Air would allow me to board WITHOUT a Balikbayan visa stamp

Firstly, balikbayan status is not a visa.

In general, ground staff supporting a flight to RP DO know about balikbayan status and its implications. Have an NSO marriage certificate with you in your carry-on baggage.

The airlines won't care about when you return, they just care that you have a return ticket.

As for the Balikbayan - that is just a stamp in your passport with a date scribbled, just stay in the line together when you're go through customs at NAIA.

What is a NSO Marriage Certificate?

I will have a Marriage Certificate issued from my local courthouse where we received our license

I am being told that when checking in at the airlines for a boarding pass that is when they will check to see if I am in compliance with Philippine 30 day departure rule and if I cannot show a ticket that takes me out of the country by the 29th day I will be denied a boarding pass

I understand once we arrive in the Philippines I stay with my wife at immigration entry point and she can request I be given Babikbayan entry stamp

NSO Marriage Certificate is if the marriage took place in the Philippines. From what I gather from your posts you were married in the USofA so use your marriage certificate from USofA and you will have no problems.

If you are uncomfortable then print off the information from the official Philippine website for the Balikbayan to show the airlines that you will avail yourself of that "visa".

From the Philippine Consulate website:

Balikbayan one-year visa-free stay

Balikbayans – any overseas Filipino returning to the Philippines, including former Filipinos who have acquired foreign citizenship – can stay in the Philippines without a visa for a period of one year. The balikbayan visa-free stay privilege is extended to the balikbayan’s non-Filipino spouse and children, provided they enter the Philippines with the balikbayan.

Former Filipino balikbayans traveling to the Philippines are advised to bring either their old Philippine passport or copy of Philippine birth certificate as proof of their former Philippine citizenship. Accompanying family members of the balikbayan can bring appropriate supporting documents:

  • For the spouse: copy of marriage certificate
  • For each child: copy of birth certificate
  • For adopted children: copy of adoption papers

Philippine Law (R.A. 9174) provides benefits to baikbayans:

  • Tax-exempt maximum purchases in the amount of USD 1,500, or the equivalent in Philippine and other currency, at Philippine Government–operated duty free shops
  • Exemption from Travel Tax, provided that their stay in the Philippines is one year or less. If their stay in the Philippines exceeds one year, Travel tax will apply to them.

Philippine National Statistic Office, have you already filed a ROM with whatever local Philippine embassy/consulate serves the jurisdiction you were married in? You'll need one when your wife renews her passport in her married name in any case. In lieu of an NSO certificate you may be required to authenticate a foreign certificate with the local Philippine embassy/consulate.

NSO marriage certificate is the CEMAR, same as the CENOMAR only not. ;) If you did your Report of Marriage through the consulate near you then NSO has that information. But not sure why you want it.

No the airline does not check to see if your return ticket is within the 30 days, never have with me. Relax you are worrying too much.

Yes we did ROM

I just ordered a NSO marriage certificate $20 and 6-8weeks to receive it

I will also carry my Marriage Certificate issued here in America where our marriage occured

And also a printed copy of the Balikbayan statute

Thanks for the encouragement! lol

Don't know what I'd do if was denied boarding the plane here in Virginia bound for our first stop in Korea!

This will be our FIRST flight together

Also we were a bit worried our trip would foul up ROC and later citizenship

But it is our understanding she can stay less than 6 months without repercussions
