Hiiiii - I'm helping my brother to fill out his AOS form. This is his situation. He is an American citizen that works and lives in China with his wife now. He's petitioning his wife to come to USA. His 2013 year income does not qualify to be a sponsor for is wife. Do you know which form (s) that he needs to fill out?

1) I-864 for him anyway since he's working?

2) I-864 for me or I-864A? - I'll be his sponsor.

How many sponsors can there be on the application? The more, the better?

petitioner (him) always fills out an I-864.

a sponser also fills out an I-864.

if the sponser filed 'marriage filing jointly' with a spouse on a income tax return, spouse must also file I-864-A.

That's it.

1. The petitioner must file an I-864 even if he has no income.

2. You are the Joint Sponsor. You file your own I-864.

There can only be one JS. However, you can add the income of qualified household members to meet the I-864 requirements. A household member must be a spouse, parent, or child who lives with you. (i.e., your spouse can add her income to yours as your household member.)

sorry i came across reading about form differences between I-864A and I-864. Saylin said I864 for co-sponor. But if we live in the same household, we can use I-864A? so my brother has been living with me when he's in USA. And when his wife comes, she'll live with us too. Should I fill out both I-864 and I-864A just to be safe?

Visiting and staying with you does not mean he is your household member.

You have been advised to file the I-864.

Why the heck would you want to file the I-864a and have to count your brother as part of your household thus increasing the amount you need to qualify to sponsor? Why would you want to make it harder on yourself? Why would you not rather file the I-864 where you don't have to count your brother?

Up to you what you want to do, but the smart move is to file the I-864.

P.S. Has your brother been filing US tax returns showing his Chinese income as required under US law? US citizens are taxed on their worldwide income even if nothing is earned in the US. No US tax returns = no visas.

Read the instructions document for the I-864 to make sure you have the required financial documents to be a co-sponsor. Not sure if Tax returns are all that you need to be sufficent. Better overprepared than delayed by months....

checklist came today.

I did file correctly for myself and my co-sponsor. However, co-sponsor (my sister)'s husband now needs to fill out I864, i turned in I864A. They need I-864, not I-864A.

So frastrating!
