I-134 Questions

Hello.

I am a US citizen and I am filling out an I-134 to sponsor my mother-in-law for a tourist B-2 Visa. I have a couple of questions.

In question 7, where do I list my retirement accounts (401K, IRA, IRA CD)? The choices are "I have on deposit in savings banks in the United States:" or "I have stocks and bonds with the following market value…". The IRA is with Bank of America, the IRA CD is with OBA Bank, and the 401K is one of the Federal Thrift Savings Plans (Lifecycle Funds). I suppose the first two would count as on deposit in savings banks? What about the 401K? Is that stocks and bonds, even though it's a retirement account?

I'm confused about whether to include my wife for Question 10 ("I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services on behalf of the following person(s)."). I sponsored my wife for a change of status to Permanent Resident (green card), which she received. When we began the green card process, she was already in the USA on a student visa (before I met her), but it had expired many years earlier. I'm not clear on whether the change of status (green card process) is categorized as me submitting a visa petition or not (green card was based on our marriage).

an I-134 plays no role for those applying for tourist visas....this form has already been shown to be legally non-enforceable. Anything written on it is worthless....no one who signs it can be compelled to pay a nickel towards any expenses incurred by the B2 visa holder while in the US...

Really? This is the first time I have heard that response. Whether it is true or not is kind of irrelevant to my question. My main concern is to do whatever I can to make sure my mother-in-law will be given the B-2 visa, and I naturally want to fill out this form correctly, whether it is enforcable or not.

RhettVoe's answer is correct. An I-134 is not legally enforceable and therefore more or less useless for a tourist visa. You can't help your MIL get a tourist visa; she has to apply on her own merits (proof of strong ties to home country).

Be sure your mother included any and all evidence that ties her to back home so they are convinced she will return.

You showing all the money you have to support her just shows she has a stronger tie to US and you her son-in-law don't you think. Especially with now a daughter far from her. The ties get stronger and stronger towards the US.

What will she be showing as far as her ties to her country?

That is a very interesting reply. I didn't think about it from that angle. She owns her home, she has two other children still in her country, plus a grandson, and all of her other family. She has no intention of staying and I think she has enough evidence to show that. But it's a good point you make. Thanks.

Its just I see over and over the US citizen showing all this support (which seems normal) mom and dad coming to visit you want o show they won;t be homeless and well taken care of. But immigration thinks different and wants to know what job, spouse, kids, property something will want them to not want to stay.

So all you listed is good to show she has much at home to return to just coming to see daughter and return back.

Just know your wife overstaying on her visa could make it a deal breaker. This is one reason why so many get scrutinize because they may think "mom will come here adjust status. Than she will start bringing the rest of the family".

Remember think like the CO not like you.Just throwing out scenarios to prepare you.
