Hello, I was wondering if anyone on this site has have a similar situation as mine. I petitioned for my husband and step-daughter while I was a LPR, shortly after, I became a USC. I sent the proper documents to upgrade my petitions but they never received them. Both of my petitions were approved, but because my category of F2A was never change to IR, my petitions were put aside to await visa availability. I sent a copy of my USC certificate, la letter explaining, and NVC case numbers. It has been almost a month since I sent those papers and still nothing. It has been more than 90 days since NOA 2. Has anyone have a similar situation and then later on work out without problems? Thanks in advance.

It takes a few months for NVC to upgrade you. What is your PD. Did you send your certificates to NVC? Or did you just send everything to USCIS? If so you need to notify NVC otherwise you will sit a long time. Because right now they are not even processing people at NVC (not allowing you to pay invoice or go forward) unless you are within a year of the current Visa Bulletin.

The Visa Bulletin now is at 01MAY2012

There's quite a few people in your boat. I know 4 waiting since April Case Complete even but they will have to wait maybe 1 to 2 years. Hopefully not but you never know.

Thanks for replying. My PD is November xx, 2013 and I sent the copies to NVC. I just wanted to know if this was a normal bump on the road before I start a fight against NVC. I posted about this before and I got a little worry with some of the answers I got. For example: one of the answers suggested that my case may have been moved to NRC, and it that is the case then, NVC won't be able to upgrade my petition because is not there anymore. Every time I call NVC I ask if they have my case and they say yes, they just don't have the actual copies of my USC proof yet. The last time I call, they told me that it takes 4 to 5 weeks to process mail. I am praying that it is true and that it hasn't been moved to NRC.

IF NVC tells you its there then just know that they are super backlogged and will always tell you 30 days. So tranquila they have it and will process it.

No es fácil quedarse tranquila and just wait. You know what I am talking about.
