Affidavit of Support Question - Funds in my account

Hi everyone!

Sorry for the newbie question, but I can't seem to find an answer elsewhere.

So, I currently live and work overseas with my husband. I've managed to save a bit less than $20k over the course of the year. The funds are in my U.S. bank account, however I'm sure when I move to the states, I'll need to use those funds while looking for work.

We have however also recieved a hefty marriage gift from friends and family. If I deposit that money in my U.S. account where the rest of my funds reside, and the total in the account is over the minimum poverty level (19,000K - around this amount), is that acceptable for USCIS? Or, will I still need a sponsor? I think I just heard somewhere that the money considered cannot be a gift.

I'm not an expert on this but we are in the same situation. My partner lives in Australia with me and we also have around $20000 saved. We have gone through an attorney who told us that we couldn't use this money for AOS and needed a co sponsor. We have used her mom. We are going through a K1 though so it could be different?

When using assets to complete an I-864 for a spouse, you would need to show three times the difference between the shortfall of your salary to the minimum requirement for your family size. If it was just you and your partner, and you weren't working at all, you would need to demonstrate approximately $60,000 in assets (~$20,000 x 3).

If you are trying to qualify on assets alone you need 3 times the amount so thats $19662 X 3=$58986 you will need sitting in the bank.

So yes you need a co-sponsor.

What if I do work though and I also have savings in the bank from my earnings that I have saved up from work?

Sorry let me rephrase - Working abroad for about 10 months so far, I earn about 20k so far that I have saved up. I intend to go back to the states in a few months for school and to find another job.

If I do find another full time job fairly quickly that pays me more than above the poverty line, do I still need a co-sponsor?
