Ok so this is what happened, I boarded a plane to Mexico the 13th took my extension letter with my expired GC and my passport, I stayed there 7 days. I had no problem getting back. I get back yesterday check the mail and lo and behold an RFE!! I mean seriously? we have a child together, sent photos of her birth and of us along with the birth certificate and documents of rental contract/bank statements. What else do they need? I think this is just a way to excuse the ridiculous amount of time they're taking to process these cases...I mean what else can I send for proof? Ridiculous!!

Sorry to hear that gaby08 - it's the worst feeling...I got mine last week after waiting all that time! We sent the package yesterday and we included the following: Bank Statements for the entire time we were married for both checking and savings; Insurance Details for the entire time we are married for the car; Life Insurance showing me as the beneficiary; Power of Attorney; Tax Returns for both 2013/2014; Drivers Licence showing the current address we live at; Two Lease agreements from Hawaii and Charleston (where we live together now); Cards we sent to each other for different occasions; Flight Details going on trips together; our reservation for our up coming trip to Disney; Affidavit from my employer; Letter from the Electric and Comcast showing I am on the account; Hotel reservation for our trip to Maui together.

Plus the stuff we went the first time which included a document showing we bought a car together; photographs; two affidavits; Bank Statements;

Hope this helps - we sent ours to get there in less than a day to spend this up a little more!! Good Luck :)

Calling is a waste of time. Called, they called me back to say "you have one year extension, it can take up to a year for a decision, if we need anything we will notify you"...so I said, the processing time on the website isn't accurate, she said , well it used to be six months, now applications are taking longer. ..thats BS. Im disappointed

By far I cannot even imagine the disappointment you are feeling right now. I bet it is because the amount of time you guys have been waiting is beyond long and also the other option which is quite possible is they simply lost your paperwork. They see you on their screen as submitted but incomplete, they cannot find any of the paperwork you sent them and now they send you an RFE. I seriously think they lose paperwork. I wish there was a way to prove their negligence towards our packages.

Be nice enough and send them the package again, send as many things as you can and politely attach a cover letter.

In the boat that we are nothing left for us to do but sit around, wait and provide them with whatever they need.

Hello everyone,

I really need your opinion/insight/advice. We are a September 2014 filer, filed on Sept 19 to VSC and got an RFE on March 20. My husband and I will send out our additional documents for the RFE tomorrow. I don't really know how long it will be processed. The RFE indicates that the last day for us to send in addition documents is June 15.

I'm having some sort of emergency. I'm currently in graduate school while working full time. My program requires a trip abroad for a global consulting project to graduate. I knew and understood about this condition before I applied to the program. After speaking with the local USCIS office, I was fairly confident that I'd have no problem traveling out of the country and come back. After we filed I-751, we went to the local USCIS office to get the I-551 stamp valid until Jan 2016. We also confirmed with the officer again about my traveling abroad for the school trip, and he said I'd have no problem at all. I felt assured until we got the RFE. I'm very confused and worried. How does the RFE affect my coming back to the country should I go abroad? I need to be out of the country from June 12 to 19. In addition, the country I'm traveling to will require me to apply for a visa since I am not a US citizen.

An additional detail is that I lost my 2-year green card. We filed some form (I'm sorry I can't remember at this point; I had a long day at work) to replace my lost green card within the time frame of 2 years, very well before the deadline to remove the conditions. However, the VSC took such a long time to process our application that it was so close for us to file I-751, so they denied our application. I've never got a replaced green card depsite all the documents, almost $500 filing fee, and trips to the local office to get a stamp on my passport for permanent residence proof for driver license.

Should I take a chance to go ahead with the trip so that I can complete my program?

My professor suggested that I requested a parole probationary status with my program office, which means I will go on a trip with students in other programs instead of my classmates. My professor, however, advised that it's best if I can go with my classmates. I also prefer to go with my classmates since we are the first cohort of the program I'm doing. I really want to follow through with everyone in my class until the end.

Would the stamp I-551 on my passport and the extension letter be enough to leave and come back to the US? Will the RFE prevent me coming back to the country?

I googled about my case and found this:

"You can travel during the RFE period & shouldn't be given a hard time by CBP as long as you have a valid passport, your old greencard and the 1 year extension receipt.

With that said, if they issue a denial while you are gone ... CBP will know this and they might put you into removal proceedings when you attempt to enter the US... "

I think with the form you filed that you lost your GC and the stamp you should be good to enter the country. Also after the RFE the worst that can happen is an interview, which if it's in the time frame while you are out of the country, your spouse can call and reschedule. If it gets to the point of interview, which I doubt. I don't think immigration will go into removal proceeding right after an RFE.

A good idea will be to call Customs and Border protection since they deal with these kinds of situations all the time 1-877-CBP-5511. They will be able to tell you right away what you need as far as paperwork.

I'm not going to answer ALL of your questions but I'm confused about you having your stamp in your passport AND your green card. When I got my stamp in my passport they took our green cards from us. So it would have been out of your hands even if you went to get a stamp and had not lost your green card. Your trip is way before your stamp expires. The stamp in your passport is the same as having a green card.

The RFE has nothing to do with your travels unless you get denied to remove your conditions while you're gone OR get called for an interview as a next step. If you have UNTIL June to respond, then gather your items and respond in a few more weeks maybe. It isn't like they're sitting there waiting for YOUR package. They will receive your package in time and either ask for MORE evidence which you will deal with when you get back or they'll tell you that you have an interview.

Just my opinion, take it or leave it.

I lost my 2-year green card only after a few months I got it when we went to a movies together. Someone stole my wallet. I was naive to carry it all the time with me because of the letter sent together with the green card. It says I'm required by law to carry it all the time with me. I've got 3 I-551 stamps on my passport since I lost the green card. So, I didn't know they take the green card from you when they give you a stamp while the I-751 is being processed. I just assumed you could keep it since other people in the forum wrote they carried the expired green card with them when they traveled out of the country.

You pointed out what I'm worried about the most that I'd get denied to remove my conditions while I'm not in the country or get an interview during the time I'm out of the country. I have a full-time job, so I'm really worried and concerned about not being able to come back to the country. We've gathered a lot more documents this time and are trying to get the package out tomorrow.

My wife lost her wallet including her green card after we filed for I-751. We are planning to go out of the country next month but since she lost her expired green card, we made an appointment with local USCIS office and explained the situation and she received a stamp on her passport I-551. We asked the officer if it’s okay to travel with I-551 the recommendation was that we do not travel while pending I-751. That being said, from my research I-551 is like a passport which will allow you to be admitted back to USA from over sea travel. As of last week, my wife received her I-751 was approved and now she will be travelling with the green card.

As side note, I don’t care what everyone says, losing a green card in the future will not only be costly but way too much hassle. Maybe just carry a copy and keep the real one at safe place.

Has anyone experienced running into trouble by not carrying the green card?
