Confused of filing I-864

Hi Vjer's,

Hello everybody,

I have to fill out I-864 for my step-son, I am getting confused on I-864 Part 6 No. 5 as it says: "My current Annual Individial Income is" and on Part 6. 13.a. says: :My total income "Adjusted gross income on IRS form 10EZ" . On the first one do I have to put the before tax ? On the 2nd one what if the total income is in the amount where my income and my wife's income was combined? . I got confused and does she needs to fill out I864a? My last paystub total annual income for 2013 is far more different from what my W2 because 401k is not taxable therefore if don't show on W2 but it shows on my paystub. TIA

I hope someone can help me clarify this things. Thank you.

For other governmental type forms like for college and the VA, we had to show the amount of FICA and and Medicare income we were earning on our W2's. Then how much we have in our 401K. For forms like this want your income and assets to be as low as possible, but won't let you get away with it.

Since I had my own business, and single, was using a good share of my gross assets to put back into my business. So had to submit a financial statement to the USCIS for that I-864. In this case, you want to show how rich you are.

Ha, at our AOS interview, was a situation where a lot less of my income would go back into my business, and a lot more for my new dependents. Wife also submitted the I-864A with her assets. USCIS wants to make sure you are not bringing any poor here. And that you have the cash to maintain them at 125% of the poverty level for the next ten years.

Putting money away for a 401K plan is part of your income.

Thanks for the reply, the gross adjusted income which can be found on my W2 is more than enough for 6 people , just wanted to know cause according to my actual annual income last year (last paystub) it is more higher than my W2 since i maximize the 10% employee share for my 401k. I guess i will put the actual income on I-864. Part 6.
