Hi everyone,

I hope anyone can help us out. My (now) husband entered the USA on a K1 visa and we have filed for adjustment of status and received EAD and AP right away and an interview waiver for the green card which won't probably come till 4 months from now (according to the letter we received from USCIS). My husband and I wanted to travel back to his country soon, probably before he receives his GC. We know we can do that with the AP, but we are worried that back at his country they might give him trouble and ask for proof that he's allowed to go back to the USA, since obviously the visa he originally received expires as soon as he entered the USA the first time. We were wondering if a stamp on the passport for proof of employment in the USA can be issued at all either by USCIS or the airport so we have enough proof on his passport that he's authorized to work in the USA? I tried to look it up online but couldn't find anything. And it seems like there are no numbers for the local USCIS offices. Any help or input would be appreciated! Thanks!

If he hasn't overstayed, your husband's EAD/AP combo card (assuming that is what your husband was issued) should be sufficient for the travel you describe. The laminated high-tech card is more secure than the paper document that was issued previously.

Congrats on your AOS interview waiver, they often take longer to process, but no interview can be a bonus. Who knows maybe his 2 year conditional GC will arrive prior to your travel?

Thanks for the reply guys!!! Yeah, I understand that his EAD/AP combo card is sufficient for traveling purposes to be paroled back into the USA, but we're just worried about back home. They might not understand what an EAD card is and ask for a stamp on the passport. I read somewhere that some people get stamps on the passport for employment authorization. Is that a different visa or something? And yes, it would be nice for him to get the GC before we travel for sure!

Haven't heard of an official EAD stamp. A few months ago, there was some erroneous information floating around the internet about some supposed bogus and unfounded activities at JFK. Maybe that is where your "read [it] somewhere" came from?

As mentioned in the February 2011 USCIS link, the official combo card format was intended to replace the previous official paper EAD document, there is no mention of an "EAD stamp." Besides, I am a bit confused as to how a US Employment Authorization Document would be of use for immigration purposes, it's primary use is for presentation to a US employer to show the person has DHS permission for work in the US? The AP part of the combo card is for presentation to US CBP at the US POE for "parole to the US" purposes. Assuming that your husband still has a valid passport from Egypt, it shouldn't be a problem. Perhaps you should check with Egyptian immigration to confirm the requisite travel documents?

Good luck on your travels.
