I went to my visa Interview and the lady at the embassy did not check any document, she asked me:

VO: What is the propose of your trip?

Me: Visit USA and tourism

VO: So you love to travel?

Me: Yes, but my last trip was 2 years ago (which is real). And now I have the possibility to visit miami and take the ocean cruise, the cruise is a gift from my boyfriend.

She did not let me finish my answer and just slipped me the rejection letter and said goodbye.

What my chances are to re apply and get approved?

Should I change my answer next time?

Seems strange. The part about the cruise being a gift did not help your case. You need to prove compelling ties to Brazil to get a visa. That means you need to show that you will return to Brazil. That she didn't ask about evidence of that seems a little odd to me. Your boyfriend is US Citizen? If so did the VO know that? If so having BF pay for the trip also did not help you. You need to be truthful in your interview but remember that by US law the office has to assume that your intention is to stay in the USA after you arrive it is your obligation to prove that you have compelling ties to Brazil that will insure that you return. A job, family, a house all help but in the end the determination is entirely up to the VO.

My boyfriend lives here in Brazil, but he can't go with me, I will go on a cruise with my friend and her daughter (they live in the US). But the VO did not let me finish my answer, I could not say my boyfriend lives in Brazil, she just refused my visa and said goodbye, I do not understand why, the whole process toke about a minute or so.

Can I re apply and give the same answer again or change the answer?

Nothing changed. I didn't even bring any documents or evidences the second time around. I told the same answers but the CO was different so I got lucky.

Sure did.

You can apply as often as you need and while other people say that your chances decrease, it's not always the case. I applied 3x and still got a 10 year multiple entry visa.

Also, I was single and child-less when I applied.

Gustavo,

In answer to your two questions:

Q/ What my chances are to re apply and get approved?

A/ You may apply as many times as you'd like. Each application will cost $160. There isn't any numerical limitation on the number of times you may apply. There isn't any way to know if you'll be approved on any subsequent applications as the CO's decision is partially (mostly?) subjective.

Q/ Should I change my answer next time?

A/ Should the same or similar question be asked at another interview, (and the circumstances haven't changed) simply answer it truthfully. Don't change it just to change it in the hopes it will be received more favorably. While I don't have intimate knowledge as to whether CO's are making notations in the application file, it wouldn't surprise me that they wouldn't. They could compare your answers from your first interview to see if anything has changed.

I have read countless entries in the Tourist Visas section and it's not odd at all that you weren't asked to provide any documention. As has been pointed out many times by other posters in other threads, paper documentation doesn't prove anything as paperwork can be forged. It was also pointed out that the determination to either grant or deny the visa most likely has already been made prior to the actual interview. The applicant is always considered to be an intending immigrant and the burden of proof otherwise rests with them.

Don't let that discourage you. Poster SennaBrigante comment is evidence that subsequent approvals can happen...and the Philippines is considered a high fraud country. It gives me hope for my wife's family to receive approval on their next application.

Good luck.

Gus, there is no waiting time required before you can reapply, but it won't help you much if your circumstances have not changed. What you can do, is schedule another interview, bring along your documentation and ask for an explanation as to why you were refused in the first place. Your answers should always be honest and true, which means don't change them unless your actual situation has changed.

Chances are you were denied because you are single, mid-late twenties and don't have a lot to ties to your home country. If you're going to try another interview bring along documentation that would evidence your need to return home after your intended stay in the US. It won't guarantee you will get a visa, but you will be better prepared if asked to present any documentation to that effect.

Good luck!

You can reapply any time you want, but it might result in the same. It is not so odd that no documentation was not asked or checked. But also I know well that there are some individuals at the consulates/embassies that made their mind the second they see you and there is really not much recourse, other than re-applying. As others had said, it is possible that a diff VO would result in a diff outcome, but you don't choose who is going to interview you.

There is the chance that something you wrote (or did not) in the application is what triggered the immediate denial.

Unfortunately, there is not much you could do other than re-apply

Try and rehearse your answers after reading posts here. Try and appear confident and maybe not so cheerful and chatty if you were before. Just smile a little. Also, it is not best to add details unless asked.

My (now) fiance from Brazil got denied a tourist visa twice. He wanted to come here to meet and visit the USA, and then go back home where we would apply for the K1 visa (which we have now done). After the second denial, we decided it was better for me to go to Brazil for us to meet since getting a visa for Brazil was easy.

I have since heard from lots of people that their US visas have been denied for the same reason as you and Eduardo - not strong enough ties to Brazil.

Good luck. I hope it works out and you get your vacation! I'm jealous of the opportunity!
