Hi,

I am about to "move" in with my Fiance who is the American Citizen and who will be petitioning for me. Am I allowed to be in the country and stay visiting while this process takes place? He just got a job and we are planning on filing after about a month... I plan to stay in the country to live with him for a couple of months... is this ok? Do you think it's a bad idea? I am a Canadian citizen so I know I am allowed to stay the 6 months.. but is it ok while the papers are in process?

Also... what if I was on a student Visa for about a month into the year, does that count as my 6 months as well?

Yes and you can stay as long as your visa allows. You'll have to go back for the medical and interview and wait for the K-1. You may or may not be able to revisit during this period.

Also, I noticed that you're in US on a F1 visa. When is your course finishing? Just a heads up, a fiance visa petition is approved in approximately 5 months (could be faster or slower). When the petition is approved in US, however, you will need to go back to Canada to complete the medical and embassy interview.

Well it ended this Jan. How will we know that the papers have arrived in the states? Will there be an online notice or something?

Yes, there will be notices addressed to the petitioner and mailed to his address listed in the application. If filed with a G-1145, he will get e-notifications as well.

As Kzielu mentioned, just be mindful of your authorized period of stay in US to avoid any potential ban in the future.
