Hello,

My last removal hearing was in Jun 2004, later I filed a petition with EOIR within a month. I returned to India in Aug 2005 which means I was in the US for a period of 8 years and a little over a year on overstay. I dont have any criminal record. I wish to apply for re-entry and would like some help regarding this

1. What is the procedure to file the I 212? Do I have to mail the application form to the consulate or complete the online form and schedule the interview in person?

2. Do I also need to file the I 601?

Would appreciate your response

First, you have to convince a CO to grant you a tourist visa....and if your application is denied, there will be no need for an I-212.....if by some long shot your tourist visa is granted, then you'll need an I-212 to waive your inadmissibility. Since the I-212's approval does not really hinge on hardships, what will you say are the overwhelming reasons why it should be approved?

You don't need an I601...If U apply for a tourist visa be truthful

the CO will advise U if U need an I 212 (one has to get after a deportation)

Be prepared to show U plan on not overstaying again, strong ties to your

country, good job and convince the CO (might be hard in your case)

If U are looking for an immigrant visa an eligible family member or fiancée

can petition U.also a potential employer can offer U an highly skilled job, lastly

the D3 visa is available for dire emergencies

d3 is the non immigrant waiver.

212's can be a pain if not coupled with a 601. Timing seems all over the place.

Hi Jawaree, do I stand a better chance if an employer files a petition rather than applying for a Tourist visa?

I guess it takes longer to get the first one.

OP seem like any visa will do NI or IV

Takes a while to get both....and D3 is also NIV (that's what U seem to want)

Many have gotten work visas through employment at highly skilled jobs and

of course the company has to prove U R really needed and their attys are not

cheap, so they'll have to need U bad to spend that kind of money.

Lone I 212 can take 2-14 mths these days if IV petition is done....A tourist visa

for U right after over-stay ?????? Try consulting a US waiver atty

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package

Gosh can we not spew too much hate..some things may not all be right

but in life some of us on this side just have to be thankful this is where

we cmae out on earth, the world's not fair but helping another if one can

is much better than hating ,after all we are just passing thru on this earth

& can take nothing with us.; at times one have to say live & let live Peace out ppl
