I'm looking for a little clarification on being "In Status" as I am not able to find one from searching and I was hoping someone here knew the answer before I called USCIS. My wife, then fiancee, came in on a K1 and we were married within the required 90 days. I did not file for the adjustment of status till after the I-94 expired which made her "Out of Status". This has caused problems with getting a state ID and getting her name changed on her social security card. Now that we have filed for AOS and they have accepted the application, but have done nothing with it, is she back "In Status" or will she be "Out of Status" until they issue her a work permit sometime next month?

That is what I thought. I guess we can give the DMV another go and see if their system will let her get a state ID now.

Depending on how fussy they are you may not be able to get anything until the AOS is approved and the green card is received.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

I went to a DMV in Pennsylvania and got my ID after marriage and then a few days later got my learners permit.

Got the ID after getting married, but before filing for AOS and got the licence after applying for AOS but before receiving the NOA1 so it shouldn't be too much of a hassle if they know how to do their job.

If they deny it I would keep trying until they say yes :P
