Hey immigration gurus!!

We, (my wife and I,) are just starting with this whole process to get her daughter here from the Philippines. Here's a little backround, and maybe a question or 2.

I brought my wife over here last July on a K1. Do to attorney incompetence, the daughter was not named on the original 1-129F application. She was named on the G325 bio and DS forms though. The lawyer was fired before the interview. I assume a follow to join scenario is not plausible(?)

2 questions:

1. Would it be more timely to have me file, (USC,) for her daughter as a 'step-daughter', or have my wife, (green card holder,) file herself?

2. As a general rule, how long does it for approval from initial filing?

I think the I-130 is the route we have to go?

Definitely you file the I-130 on behalf of daughter. Would take tooooooooooooo long if wife were to file as a LPR.

2. As a general rule, how long does it for approval from initial filing?

Hard to say how long the process will take, However, beneficiaries from the Philippines are still on the expedited track to approval. If you're proactive with gathering and submitting documents during to NVC -- that too helps move the process along.

I think the I-130 is the route we have to go?

2. Money is money, but still, how much will this venture set me back?

Oops...I'm back again. Looking at the guides, I see:

"A copy of the child's birth certificate showing the child's name and the names of both parents"

This may be a problem. Only my wife's name is on her daughters birth certificate.

As I've said, it won't be an issue because in the Philippines illegitimate children are always under the sole custody of their mothers. Even if the father's name is "unknown" or "not written in the birth certificate" it doesn't matter.

It's been done several times already for K2 or IR2/CR2 filed by USC step-parents.
