We tied the knot!! My husband and I got married last month and now we are preparing the petition hehe

It may be a dumb question..but what's next? Me, the wife, is the US Citizen, and I was wondering if I have to file for Change of Status (from married to single) first in the U.S. before I can file the I-130petition for my husband? Also, do I use my maiden name or my husbands last name as my new last name as I fill out the petition?

Could you guys help answer these questions for me..it would be greatly appreciated! Thank you all so much in advance! :D

There is no "change of status" form to file before you file the petition; just file the petition when ready to do so.

If you decided to take your husband's last name and it is on your marriage certificate, then use it when you fill out the forms. Your maiden name would go in the "other names used" section.

September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

From what I've read here and what I understand, "Change of Status" is only for non-US citizens (in your case, your husband). It doesn't mean "change of marital status" either. So, its your husband status you would be filing to change.

I'm also assuming that he came to you via K-1 visa, which means you wouldn't need to file an I-130 petition..just the Adjustment of Status forms. Read up on the Guides found on this site.

Oct. 22, 2015: Travelled to my new home :) (In order to get IR-1 Green Card) Expiration date on IR-1/CR-1 Visa - Oct. 29, 2015

Nov 10, 2015: Received Social Security Card

Jan 4, 2016: LPR Green Card arrived.

Because you posted in an immigrant "VISA" forum, the first two answers you got, presume your husband is living abroad, in the Philippines, not already in the USA. If that is correct, there is no "change of status" for either of you. Married is married and you'll file any petition, as a married person, using the name by which you intend to be known going forward.

Your name change on passport and other identification including Social Security, is an independent issue, not related to your husband's immigration in any way.

If as one speculated, your husband is already here as a result of an already completed K1 fiance visa process, you do not file an I-130, just the I-485. If he didn't come to the USA on a fiance visa, that advise is irrelevant to your situation.

Please clarify where you married, where your husband now resides and where you reside, so we can reliably point you in the right direction.
