Timeline
My spouse living in richmond filed I-130 for me on 22 Oct 2013. We received a RFE in our case on 5 May 2014 from Vermont service centre of USCIS.


RFE states following short fall


"you did not submit sufficient evidence that a legitimate marriage exists between my spouse and me. Therefore additional evidence is required"


I would just brief the evidence which are already submitted to USCIS to prove our marriage to be legitimate

1) marriage certificate

2) Affidavit from my relative


I do not have any other proof like joint bank account,insurance,property,etc as we only stayed for 3 months in India and then she went back to USA. Now I am perplexed how to proceed further in the case.


Any suggestion/help???? thanks in advance... :)

This is the list provided on visajourney in regards to bonafide marriage proof:

Evidence of Bona fides of Marriage

(include as many as apply to you)

Affidavit from petitioner and beneficiary verifying the marriage or relationship

Affidavit from witnesses to the relationship/marriage (parents, siblings, other relatives, close friends)

Wedding announcements, invitations

Church certificate

Wedding pictures

Joint bank account letter (when opened and balance) and recent statements

Joint credit card statement - including receipts from charges made by both of you

Evidence of joint life and cohabitation: monthly bills, insurance, assets etc.

A deed showing co-ownership of your property or a lease agreement with both of your names on the lease

Receipts of money transfer (if applicable)

Phone bills showing your conversations

Receipts of gifts sent online or otherwise

Transcripts of IM chats or Skype calls

Copies of letters and/or e-mails

Copies of holiday cards addressed to you both

Birth certificate of any child that has been born to your marriage

Airline ticket receipts showing trips taken together or to visit each other -- including boarding passes

Copies of the passport stamps from any visits to your spouse's country

Pictures of you together on vacation and/or with family and friends. It's best to include a range of times, not just a bunch of photos from a short period of time

If its typical case of arranged marriage in India, then you need to submit ample of photographs of your wedding ceremony and a letter stating that marriage was 'arranged' by family and hence only two strong proofs can be submitted viz. Marriage Certificate and Ceremony photographs.

Its good if you send following photographs which include:

1. You, your wife priest (Kanyadan pic is best)

2. Your parents and your spouse parents.

3. Crowd present at your marriage.

4. Photographs of different pre-wedding ceremonies and dates when they took place. (Sangeet Sandhya, Mehendi etc)

Print the photographs in such a way that description is stated below; for e.g. "From Left: Her Father, Me, My Wife, My Father". (Something similar to newspaper article pics)

u told u guys stayed 3 months together then u must have some photos together of different occasions. Main is of those marriage ceremony.... if u can provide the log of your call history then that is best coz it shows that u guys r in contact with each other. U can provide list of any money transfer paper if u have, emails or chat histries, any bills on both of ur name.... these will help u lot to prove relationship between u guys.
