Hello everyone,

I could really use some help on this issue. I am hoping someone out there has run into the same situation. MY husbands I-130 just got approved we are waiting to hear from the NVC. I know the next step includes the I-864 AOS.

A little background. I have lived abroad in Panama with him for the last 4 years. We got married last June 15th here in Panama. I do not have any source of income. We live off of his income and my shrinking savings. I filed taxes this last year because I cashed in a small IRA fund. But there was no employment income (W2) for the past 3 years. I was advised to file single??!! So I am thinking this will cause more trouble then helping. The IRA was only a few thousand dollars.

There is a line on the I-864 that says the immigrants income can be used for AOS if it will continue from the same sourse. He is currently employed by a Huge shipping company that has many branches. He will still be employed by the current branch until the end of 2014 (even if we move to the US). After that he will transfer/be employed by a seperate branch in the US. All of his income is from Panama so there are no taxes or W2's. His income is over the 125% poverty level.

Does anyone have experience using the immigrants income as AOS from a foreign country? We can get a current letter of employment and paystubs.ANy insight would be very helpful. Thank you in advance.

Thanks for responding. So technically if I have a letter of employment for him from his current employer explaining he will continue being employed after arriving in the US that would be sufficent? Would I add paystubs from his job or bank statements (from a foreign bank)? I am worried because there will be almost nothing directly from me the sponsor :(

Yes, that's what you need. What comes from you is the signature on the affidavit. Your spouse is self sponsoring.

Question? Does your spouse have savings? I ask this because Because sometimes they take issue with self sponsorship and any "proof" from foreign countries as they cannot be authenticated....

For example... In our situation, (I realize it was a different consulate and each one has its own standard practices they follow).. We had pay stubs, letters from employer that his job was continuing in the USA (it was a Danish company), bank statements from Italy showing we had over 20X the poverty amounts in the Italian bank accounts and NONE of it mattered... The ONLY thing they wanted to see was 3x the 125% poverty (or approx $60,000) in a US bank account... So rush, rush, We had a few thousand more transferred and consolidated our accounts had the bank print a statement showing we had 60k and showed them this the next day at the consulate... And it was all good (I am self employed so did not make enough salary wise) ...

You might look into recent reviews for Panama and see if they have any "financial quirks" that you need to be aware of to avoid any surprises... I know the UK consulate regularly OKs self-sponsorship but some are more picky... Better to be prepared with a plan B just in case...
