Total Income on IRS Tax Return Transcript

Hi I am double checking my joint-sponsor's I-864 form and I want to make sure she wrote the correct total income number in Part 6 question 13 a,b,c

I only have the IRS Tax Return Transcripts and she won't to give me the original 1040 Tax Forms so that is out of the question.

My question is how do I find the correct total income for Part 6 question 13 a,b,c?

Oh I found a line on the Tax Return Form that says "Total Income: $xxxxx" but she filed jointly with her husband so that would be both of the income together right? He did not file a I-864a as she is well above the poverty line and doesn't need his income to support an immigrant.

I know this might seem a little obvious or a stupid question but I just need to know 100%

Not a stupid question at all. However, if your joint sponsor files jointly with her husband, you are either going to need the complete tax return and W2's to show HER income alone qualifies, or an I-864a from the spouse. A TR transcript won't do that. In reality though, it's quite likely the Consular Officer will require an I-864a from the spouse anyway.

Total income from the three transcripts or returns is about the past though, unless she is "self employed". For an employed sponsor, you'll also need evidence of current income. Total income for 2013 is NOT current income unless self employed. IF self employed, expect an i-864a from spouse to be a requirement.

I also told her that I would need her complete tax return and W2's to show her income alone but of course she said she is filing an extension for 2013 tax return so she doesn't have it. I have a feeling this whole AOS package is going to be a disaster with multiple checklists because of her.

Correct, so don't send the AOS until you have everything that's needed. Do it right the first time.

Is your joint sponsor self-employed? Usually it's only people with complicated returns who are either self employed, partially self employed or have multiple passive sources of income, who file extensions.

Looks like at minimum you're going to need that I-864a. Exactly what you'll need depends on circumstances, we don't have enough information to evaluate. At this point, neither do you.

If your sponsor has a good history of income far above the required amount, for 2010, 2011, and 2012, you MIGHT just get by with I-864, I-864a, all three tax return transcripts and evidence of filing the 2013 extension. I wouldn't bother proceeding without all that as a minimum.

Her husband is self-employed and since they file jointly that would be why they get an extension every year. Her income alone is far above the poverty guidelines so I'm really not worried about that. I am worried that they will make him file I-864a.

I have her 2012, 2011, 2010 tax return transcripts and proof of extension for 2013.

Do you know if they specifically request i-864a on the checklist?

Yes, in this case, count on it. Because you are using transcripts, they can only see combined income. A TR Transcript would not even contain any evidence she earned a penny during those three years. What were you planning to use as evidence of her "current income"? You don't mention that at all. You certainly have ZERO evidence of her past income.

As proof of current income I have her employment letter which states she has been working there since 1997, her current occupation with the company and her annual salary of $XX,XXX USD.

She could include her W2s for all of those years. In the NVC thread people have been successful with MFJ and including w2 of the joint sponsor vs an I-864a from their spouse

Ok thank you, I will ask her for the W2's, If she doesn't want to hand those over than her husband can fill out i-864a.

That's a compromise that might work.
