Hello Friends ,

Hope you all are good ...

I want to know some clearance between CR1 & IR1 green card period

I know CR1 are those who apply I-130 before 2nd anniversary of their marriage and receive conditional green card for 2 year...

If the same person enter in USA after a day of 2nd anniversary so which green card he/she will get ???

Remember he/she apply as a CR1 beneficiary but enter in USA after 2nd anniversary

Example : 2nd marriage anniversary on 1 Aug 2014 , got 6 month visa on 25 July 2014 and enter in USA on 2 Aug 2014

Is he/she receive unconditional 10 year green card ?? if yes then after how many year he will be eligible for citizenship with 10 year green card ???

Looking yours precious response

It will depend on the date printed on your entrance visa when you get it.

When you get your visa, immigration will tell you what to do to Adjust Status to the 10-year card. At your point of entry, the officer will help you with that. Try not to worry over it; they'll tell you what to do at POE, and if you still have questions, ask them then.

When you enter the country at the POE... When you hand in the package, be sure to notify them that you have been married for over 2 years and that you are eligible for the IR1... If you don't point it put to them, they will likely miss it. There is no AOS with cr/ir1 visas. If at entry to the USA you have been married for over 2 years, you should be processed for the IR1 and you will receive the 10 year GC ... But you have to speak up when you enter.

It in not a decision.... IF, at the time you enter the USA you have been married for over 2 years... THEN it is processed as IR1. IF at the time you enter at POE in the USA you are married less than 2 years, it is processed as a CR1 .... I say you need to alert the officer at POE because they will not usually do the calculations... It should be pointed put to them that you have been married over 2 years... No "decision" just a fact that they sometimes overlook if you don't point it out to ,them.
