Hello :-)

I have been doing some research for awhile now however id like to get some suggestions from you guys!

My fiancé and I are going to start our k-1 journey soon but I'm unsure as to when We should start it as he is currently here in Australia with me and is leaving to go back home to the states in May. Currently he is not employed however as soon as he gets back he is getting straight into job hunting.

I just want to know if it's a good idea to a) start the process when he gets back and lodge it with only a co-sponsor or b) wait until he gets a job, lodge with cosponsor (for more assurance) and send it off?

Like everyone we just want to be together as soon as possible however I don't want to rush it and ruin any chances of us being together....

Any suggestions will be greatly appreciated!

Thanks

Jade

You can start the process now.

You won;t send the I-134 till later in the process, you don't send that with the initial petition.

Hi Jade I would wait until he's got a job! If they question his income and see no proof that he can support you it'll only lengthen a process that is ALREADY a stresstest. RFE's and AP are really bothering. Good luck in your venture.

Hi Jade

Start the process now! The Affidavit of Support is only needed when you interview. That might be another three - six months down the road, pending on how fast your NOA2 gets through. In any case, you will have a co-sponsor either way right? So it doesn't matter.

I filed in beginning of Nov when my fiance did not have a job yet. He got a job in Jan. We got our NOA2 in Feb, so by the time I had my interview (April), I only had a couple of his work salary receipts and bank statements and letter from employer, and it was totally fine.

PS - say you go with route b - if his job meets and exceeds the poverty limit, you won't need a cosponsor. It's not an assurance thing - they give you a very clear guideline on what the poverty limit is.

Edited by relativeways

There is no requirement to live with a cosponsor....doing so doesn't earn extra credit.

Better question is whether you two will have the means to live together in the US.....if no one has a job then how will you live?

Personally I would never offer to petition for anyone unless I could support them on my own.
