Hello everybody.

So I been reading like crazy all the topics and I am so glad that everybody helps so much . My case is a little different and I hope you guys can give me guidance.

3 years ago I married my soon to be ex-husband he was my high school sweetheart i was 19 and well to make the story short, He obtained his green card on April 2012 after i petitioned for him a week after our wedding . and he got it for 10 years. Things between us turned really BAD since there and we decide to separate. Unfortunately, things got even more difficult and I decided to come to Colombia because my dad got sick and i have been here for a year now. my marriage is completely over and now I'm in the process to obtain final judgment divorce with him since we decided that it is best for the both of us and we definitly wont go back to have any kind of relationship. i wanted to give you some background information before getting to the main point of this Sorry guys i know is long.

I met my current boyfriend about 18 years ago wheb i was 4 living in colombia. We dated when i was 14 years old for 2 years. after that i went to USA and well we drifted apart and our relationship ended and i started my life in Florida where i met my ex. i was 17 years old, young, in high school and got married. AFTER ALOT of healing, love and patience i decided to open my heart again. I known this guy for so long he has been my best friend forever an some people do say better know than stanger. Im currently on a really good healthy relathionship with my Diego again, and after careful consideration and having lived with him for the past 5 months, HE has decided to propose me and leave his life in Colombia to move with me back to florida. I have decided that i want him to be with me, to go to usa´and hopefully be with me for once and for all!!!! But I have no idea whats the best way to achieve this goal. I didnt wanted to make the same mistake as my previous marriage so i wanted him to go first and see whay live in usa is. i tried tourist visa for him 3 times and he got it denied :(. So I know we could get married here in Colombia for a cr1 visa. But Can I start a new petition on october since my divorce is finished on may 2014. Keeping in mind that I petitioned my ex 3 years ago. How long do i have to wait to get married again or what do you guys recommend.

I am a CR-1 filer living in Bogotá with my Colombian husband (we're about to move to Buenos Aires for his job, but no matter, we filed from here). I think it's great that you don't want to make the same mistakes again and have him see what the U.S. is like before you get married, but if he doesn't have a tourist visa, he can't visit the U.S., period.

The only way he could see the U.S. before marriage without a tourist visa is with a K-1 fiancé(e) visa, but it's really meant for couples who are very serious about getting married within 90 days of the beneficiary's arrival and living in the U.S. It's not a let's-see-how-we-feel-when-you-get-here visa. I suggest you read the guides (scroll up and you'll see Guides at the top of the page) to compare your options.

If you decide to get married in Bogotá, call and talk to someone at any notaría about what the law is regarding how long you have to wait to get married in Colombia after a divorce is final. They will be able to tell you if you can't find that information simply by Googling. I am not sure how long you have to be divorced before sending the CR-1 petition. Use the forum search function. Good luck.

USCIS (Priority date April 1, Approval April 17, no RFEs)

March 28, 2014: I-130 sent via FedEx from Bogotá to Chicago Lockbox

April 1, 2014: Delivered to Chicago Lockbox at 10:29 a.m. according to FedEx tracking; signed for by J. CHYBA (date confirmed by My Case Status)

April 4, 2014: NOA1 e-mail received at 12:17 a.m.; case accepted and routed to CSC for processing. Check cashed.

April 17, 2014: Changed mailing address with USCIS Tier 2 representative. He also confirmed that our case had arrived to the CSC and that our NOA1 date is April 3.

April 18, 2014: NOA2 e-mail received at 12:30 a.m. Case status online changed to post-decision activity; date of "last updated" changed to April 17. Change of address e-mail received at 3 a.m. Status changed back to initial review on e-mail and online. Date of "last updated" now April 18. Called and spoke to two Tier 2 reps; both were useless.

April 21, 2014: Approval confirmed verbally by Tier 2 rep. Order put in to send second NOA2 hard copy to new address. Instructed to ignore online case status.

April 25 or 26, 2014: NOA1 hard copy arrives to old apartment in Bogotá. Priority date actually April 1. (April 3 was the notice date.)

May 16: USCIS change of address e-mail received

May 19: USCIS e-mail received saying a duplicate notice was mailed on this date. Case status now set to "Acceptance."

May 22: NOA2 duplicate hard copy arrives to U.S. address

April 29, 2014: Case received

​May 22, 2014: Case number and IIN assigned. Asked operator about our move from Colombia to Argentina and received instructions.

May 24, 2014: E-mails about embassy change/address change sent to nvcinquiry@state.gov at 4:36 p.m. NVC time

​June 3, 2014: Payment portal message "This case is in the process of termination" appears. DS-261 appears, submitted. E-mails received from NVC concerning case number and AOS bill.

June 4, 2014: AOS payment invoiced, paid; DS-261 received by NVC

June 6, 2014: AOS payment shows as PAID in payment portal

ok i ll tell u about my experience.

i m colombian n my husband is american, he was living in bogota with me, but when we start the process he go back to usa to have the adress in usa, i dont think that is a problem, but i have in mind more about the process for taxes... bcs u have to be the sponsor of ur lover, if u r living in colombia for long time, u ll need some one to be sponsor of him in usa.... someone that get at the year U$19.662 n if u ll be the sponsor u need U$24.737, bcs u were the sponsor of ur exhus.

i dont think u have to wait to marry after u get ur divorce papers done... they only ask u r not marry.

when i marry in bogota the notaria 19, ask me:

birth certificate.... both

divorce paper previous marriages

single certificate at the moment.... my husband

cedula de ciudadania.... colombian id... mine

n copy of the passport of my husband

Thanks for your response. I just had another question did you file everything frim bogota or usa I was wondering sibce I have heard usibg a foregin country address speeds the process

Hi, we did file from Bogotá and list our Bogotá address where we live together on all the forms. Having a foreign address used to speed up the process, it is true, even though it appears they don't do that anymore. Like I said, we are moving soon and won't have a stable address for a while, so I am going to change it to my parents' address in the U.S. We sent the I-130 package one day before he was offered this work contract in another country, so we definitely thought the Bogotá address was the one we'd be using throughout the whole process!

If you marry in Colombia before your divorce is final, you will commit the crime of bigamy AND the US will not recognize the marriage for immigration purposes. USCIS can read and compare dates. You must be free to marry before marrying again. You are "married" until the divorce is final.

Facts are cheap...knowing how to use them is precious...
