Hi,

I am a Canadian citizen and have been married to a U.S. citizen for 13 years. I have been a permanent resident for 12 years.

I am filling out my n-400 to become a U.S. citizen and don't know whether to file as:

a) Permanent resident for at least 5 years

b) Permanent resident for 3 years and married to US citizen

I am thinking "a" since I will have to send in less paperwork such as evidence of marriage, etc.

Is there any advantage to applying as a spouse of a U.S. citizen or am I fine applying just as a 5 year permanet resident?

Yep, since you're eligible, just apply based on 5 years of residence, it's easier.

Just to share a bit of my experience, I applied based on 3 years of residence + marriage even though I would have been eligible to apply based on 5 years of residence. At the interview, when going over my application with the officer, she told me she would change my application so it would be based on 5 years. I didn't want to argue or go into the reasons why I applied the way I did, so I rolled with it. In retrospect I imagine it was because 1) I met the requirements, and 2) it was less work for her.

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

I had the same option—applying under either the 5 or 3 year requirements. I chose the 5 year option because less paperwork was required.

09/23/2013 - Check cashed

09/27/2013 - NOA received (Priority Date is 09/18/2013)

10/01/2013 - NOA for Fingerprints received

10/18/2013 - Biometric Appointment in Baltimore

10/22/2013 - In Line for Interview

02/18/2014 - Received text that my interview has been scheduled

02/24/2014 - Interview letter received

03/25/2014 - Interview Date

03/28/2014 - Oath Ceremony - US Citizen!
