Hi guys, I would like to ask if are there any of you there who had their embassy interview who brought a proof of an IRS extension and did it cause any trouble at all?

My fiancee is a business man so he usually files his taxes around October. Our interview date is on May 8. As what we know the embassy will require us the 2013 tax returns after the tax deadline which is April 15, 2014. In our case we would only have the 2012 taxes on my interview date (which is on May 8) since he will be filing for an extension for his taxes.

Will this affect the approval of our petition? I would appreciate it if you would share your experience/thoughts regarding this concern.

He can provide proof of an extension for 2013, but he should also supply transcripts from 2011 and 2010. This should help satisfy as long as those additional years meet/exceed the 125% income requirement.

He should use his confirmation for his 2013 tax year submittal along with the IRS transcripts for 2012 and 2011 and he will be fine.

Thank you for this info. I have his ITR from 2010-2012... What are the stuff that we need to provide as a proof of an extension. Do you know?

Thank you Sir. What you mean is I should have the documents that will support/ show that he filed for an extension for his 2013 taxes, right?

I have his ITR starting from 2010 until 2012.

Am I the only one here who has this kind of situation? :(

no, you are not alone in this. everyone has a different reason for filing their taxes when they file...some early...some right on April 15th...some need an extension, etc. You will be fine. You are correct in that you should have a copy of the document that shows he has been approved for an extension for filing 2013 taxes. Stay positive...you will be fine.

It depends how he filed his extension.

If he used a tax program like TurboTax then he would have received an electronic confirmation from IRs. If he electronically filed Form 4868 (PDF), Application For Automatic Extension of Time To File U.S. Individual Tax Return he would have a confirmation and he made a copy of his form of payment.

If he payed all or part of his estimated income tax due using a credit or debit card using the Electronic Federal Tax Payment System (EFTPS) he would have the credit card receipt and a payment received confirmation page to print out at the end of his online transaction.

If he filed a paper Form 4868 by mail then he will have a copy of the paper form and cancelled check.

There will be no issue with bringing the extension form and his 2012 tax return - embassy only wants the most recent tax return, not multiple years. Being he files an extension the 2012 tax return will be the most recent, and you for sure need to have a copy of the completed extension form.

He can provide proof of an extension for 2013, but he should also supply transcripts from 2011 and 2010. This should help satisfy as long as those additional years meet/exceed the 125% income requirement.

No sure about other embassies but for Manila they only ask for the most recent tax return, not multiple years. (transcript is accepted of course)

It depends how he filed his extension.

Timeline

U.S. Taxes does not have to be filed until April 15, 2014 for tax year 2013. If a person needs an extension all they have to do is request it. If any want proof of income all they have to produce is the 2012 Tax return . That is U.S. Law and the Embassy will not make you to produce Tax Return if they are not filed.
