Widow of American husband needs info.

Hello.

I could use a little help. My wife keeps bugging me. A Chinese woman friend, married to a AM citizen is trying to become a citizen. We invited them to our wedding in China. Because they spoke good English. And he has been living in Nanning for a decade or so. I was interested in his experiences there. And the man had a recent heart attack in Nanning. in their apartment And died .

He never filed anything to get her in to the USA. Because he was living in China .He really didn't want to go back to California . They were married three years. But have been together for at least 20. The US government gave her a 90 day visa, maybe a B2 , to bring his ashes back. She was staying at his home in California for probate court. But it looks like she gets nothing. (retirement, social security.) Because he never changed any papers stating they were married. We went to pick her up in Pittsburgh airport to visit her son , who is in University there. Apparently there is some type of deal for her to get in here. My wife says , she went to immigration in Pittsburgh and they gave her an I 360 to fill out. She has been sending me links of information that states she can come here. Because he died, and they were married at least 2 years.

Any further info would be helpful.

Thank you, Oh yea .I just did my I-485 for my wife. Two months late. And updated the timeline.

Timeline

She has 2 years after the anniversary of her husband's death to file the I-360. As long as she does not remarry, she is eligible during those 2 years after his death to file the I-360.

Since she is in the US right now, she can file the I-360 and the I-485 to adjust her status.
