Either way, there is no problem, as far as I know applying from within the USA is different from applying outside, considering the time issue. applying from within the states may take longer and more costly as it involves more applications to change status and also considering the number of applicants that want to change their status from overstaying or illegal to a legal status under marriage, you will be paying for the application processing fees and change of status application fees plus the work permit and so on. but it may take longer.

applying from outside i think is shorter in time and less costly.

if you decide that you want to be together for now you can apply for the K visa which will let you come to the states as a fiance but you have to get married within a certain time in the USA or you will lose your application and will be staying illegally and you don,t want to do that because it will scar your immigration history down the road and will affect your future applications even when you are married.

if you are willing to sacrifice being married among your families overseas you can do this

usually it takes from a year to a year and a half to apply from outside and consider more proofs because you will be considered married for less than 2 years at the time of application if you apply right away after marriage.

I advice you follow some of the forums in VJ to see similar cases but always keep in mind that each case is dealt with by the immigration on an individual basis and other cases may not have the same result as yours although the have the same circumstances.

also keep in mind that certain visas are not permitting you to get married after entering the states like the tourist visa for example, and if you get married after entering the states on such visas it will affect your application for sponsorship as the immigration will look at it as a way of conning the system, best way go through legal ways although they will take longer time but after all they are less costly considering fees and evolving immigration lawyers as such cases turn into more legal complications.

after all this is what I understood from viewing and knowledge of some cases, but however I might be not accurate, hope more VJers will add to the answers and correct me if I am wrong about something.

good luck

I say get married on the back porch of Uncle Pookie's House.

Why? it doesn't matter WHERE you get married, when chasing after a spousal visa, category CR-1.

Plus Uncle Pookie likes to rent out his back porch and deep-pit-roast a whole hawg.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
