Hey

just file as single...if the embassy people ask then tell them that u cannot file married bcoz u dont have SSN for ur wife..... i dont think it will a problem bcoz she dont have a SSN no.....so u should be fine....

Hi Dhruvp77

thanks a lot for your help. God bless u. I have already filed my taxes as single since NVC asked me 2 bring 2013 returns for interview. But have u heard abt w7 form of tax return. it gives your spouse a temporary SSN but for that u have 2 wait 6-8 weeks. that will b 2 long.So i hope everything will b fine for my wife during her interview. MEanwhile since her interview will b in May. can i get something from your knowledge from IRS in written so that in any case if CO ask my wife abt this she can show that confirmation from IRS reagrding me married but filing single. Thanks again. i appreciate your help

I agree on justgotlucky. This is the samething I wanted to tell suki4498, you can amend tax once your spouse is in US after they get SSN. Though Saylin or other expert may argue that is not right, (I'm not a expert) but I still stand on this.

If CO ask just simply explain that you are planning to amend tax return to MFJ after you get SSN. I confirmed this with my CPA also who does my corporate taxes as well.

Thanks casper212

i really appreciate for your help.I hope we r fine as i have already filed my taxes for 2013 as single. Do you think i should call IRS and tell this thing to them. May b they can give me some kind of written confirmation like it is okay 2 file tax as single even if m married and once my wife will b here i can always amend my return, just 2 b on safer side. what do think? thanks again

Yes i filed it as single and i used turbo tax

One of the cool things when you file MFS or MFJ when you order your tax transcripts they come in both your names so it looks cool

Hi Guys..I just wanted to chime in with the Filing Status. I too for 2013 already filed my taxes as 'Single'. According to my lawyer, that is incorrect. I should have filled married filing separately and put 'NRA' when it asks for my spouses SSN. Note: That if you use Turbo Tax H&R Block etc, it will not allow you to enter characters, you will have to do it manually.

As per my lawyers suggestion, I went ahead and amended my 2013 tax returns and filed the 1040X and will send that to my spouse when she goes for the interview. And since my spouses interview is Aprill 11th, they probably won't ask her for 2013 returns, since we submitted 2012 returns to the NVC, but just incase they do, she will present them with the 1040X. The 1040X does have a text box where you can enter the reason for the amendment. That should be self explanatory. And she can always talk to it during the interview if it comes up.

Just my 2 cents Sukhi4498. Hope it helps.

Hi First of all thanks a lot. You know since i m f2a category i dont want 2 jeopardize my case. i still have 5-6 weeks left for interview. So do u reckon if i call IRS and ask them if they can help me out in this. i will always amend my taxes once my spouse gets SSN. But i was searching online and i came 2 know that they give a temporary #. u have 2 use that. or i can get some kind of letter from IRS reagrding this thing and in any case CO asked my spouse can always show that. Please advice me. i will really appreciate it

In my opinion, the best thing to do is find out yourself. That's what I did. Call NVC first as you are dealing with them and explain your situation. IRS will just throw the book on you. You never mentioned when you were married as based on other's comments, that may come into play. In my case, we were married in mid-2013 and I explained this to NVC so it's reasonable for me to file Single and they told me they don't really care how I file my tax return. But if you were married 2-3 years ago you might have some explaining to do as to why you are continuously filing as Single. If this is the case I suggest you file asap an amendment (as soccerFan pointed out in the previous post) for your past returns. You will definitely need professional tax assistance to do this.

Patience is virtue, my friend. Everything happens for a reason.

Hmmm well usually 1 to 2 month.

For everyone its really 1 to 2 months. I say that because it depends when you get case complete.

This week (probably starting Wednesday or Thursday) the May interviews will start up. Those in the queue may get interviews depending on where they are in the queue.

It's all about how many slots there are and where you are in line. I have people here waiting for their embassy for months because the embassy is either busy, Or has has issues.

The norm is though 1 to 2 months after case Compete you should get a date for that following month. UK is pretty good and about all get in waiting in line here.
