Hey everyone! I hope your all doing well. I'm trying to apply for a k1 fiancé visa for my fiancé. I want to know if anyone can help me with a step by step procedure. Instead of doing it through a lawyer. But I also wanted to know that after i apply for a k1 visa can i go visit him and stay there for a few months and come back with him and get married or I have to stay in the US while the whole process finishes and he gets his interview date. Thanks for the help lovelies (:

Secondly, yes, you can go visit him, assuming you have the necessary documents to be allowed into his country. He can even come to the US during the process, although it will be up to the border official at the POE whether he will be allowed into the country.

Thank you very much! He would obviously have to apply for a tourist visa to come while in the process is that correct? And what if he does come here will he give the interview in us or in his country. Thanks a lot(:

Yes, he will need a tourist visa, or if he's in a VWP country he can use that. Depending on the country his from the tourist visa can be relatively simple or near impossible to get. It's usually likely that it'll be easier for you to go there.

A tourist visa is just that, a temporary stay. He must go back before the time allowed him by the officials at the border. Also, there are no interviews in the US, it must be done at the consulate in his country, so he would have to return either way.

Thank you so much for the help. Does the process of a fiancé visa take longer or a spouse?

Currently K-1s are going pretty quickly NoA2 approval wise at around 5 months. CR-1s (spousals) are taking 1 year to 18 months.

The key word there is currently, this can always change.

Keep in mind a few other things, like on a K-1 the beneficiary can't work and doesn't get a green card right away and needs to be applied for, and paid for, separately, to the tune of $1,070 and takes about 3 months from when you file for that to get work authorization approved, so you'll need to prepare for that cost and the cost of supporting the other party for as long as it takes them to get the authorization and find a job.
