RFE Response & Question on Age Difference

Hello,

I know this question has been asked many times but when do you think I should consider calling USCIS to inquire on our RFE Response? We sent our response almost 3 weeks ago so I start to worry that something is wrong.

Also my US fiancé is 25y older than me and I am wondering whether this is a red flag for them and they want to make it difficult for us. Could they deny us on that basis (would be quite discriminatory though)?

Thanks

What RFE did you get? My fiancé is 16 years older than me and the question was never asked during the interview. Nothing about the age gap but different consulate will probably be different

The RFE was for a legible copy of the Divorce Decree for my US fiancé. We had already sent a legible one but we sent another one as required. I hope they will not come back with more RFEs as this first one was really weird. I start to get paranoid about the whole process now even though we did everything by the book.

USCIS would not deny a petition on age reasons....they'd leave that for the Embassy.

USCIS will approve your petition based on the completeness of the documentation and required attachments, evidence of meeting in person and successfully passing all background checks.. The Embassy will determine if you have a legitimate relationship not entered into to circumvent immigration laws or commit visa fraud. Age differences can enter into the decision; those are largely country-specific.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Who is older? The man or the woman?

The man. Since the OP said fiancé is older.
