I'm filing for my husband I-130 and well i'm a full time student and stay at home mom i'm am now fully depending on my parents and my husband will be coming to parents house while he finds employment and we can move out. My question is does my dad file the AOS packet and we will also be co sponsoring by another family member.? i have had jobs but nothing close to how long my parents have worked basically do my parents and co sponsor file the packet and i just put the NVC case number ? and pay the fee's??? ill be paying for the forms myself any help would appreciate!!!

If your father have enough income for sponsoring then you don't need other family member to co sponsoring. In that case then only need two I-864 forms, you and your father. However if your father filed jointly taxes with your mother then your mother will also need to file I-864a form. Because they count your mother is co sponsor in that case.

that is the problem my parents joint filed and made below poverty lines which means we will have to be co sponsoring with another family member i will not be filing the I-864 myself because i have never done taxes and never filed for them does this mean i still need to fill out an I-864 myself??? if i have to file more than one I-864 will i have to pay them separate or are they included in the AOS packet including the I-864A? all together? we have a very big family in this house 7 people not all adults...? and this is the house where he will be arriving to if god willing this process goes by fast!

Do I have to file a I-864 and also my Father and also my mother I-864A, and the co-sponsor I-864A are they all 88 dollars??

so confusing i know please help

hi

your parents don't have to be your joint sponsor just because you live there

you are the primary sponsor no matter what, but any USC or LPR can be your joint sponsor.

you have to file the i864 as petitioner, you will put $0 on your form and attach a letter explaining why you weren't required to file taxes

anybody else can be your joint sponsor

it's only one fee $88 for both forms and all the documents, yours with your i864 and your joint sponsor with his or hers documents all together are sent

Like aleful stated, you only need to pay the fee once no matter how many I-864 you or your sponsors filed. Also since you are the petitioner, you automatically become a sponsor. So you do have to file I-864 no matter you have income or not. If you had never filed taxes for the last three years then you need a letter explaining why. In order to help meet the income requirement there is one way other people can help you is use cash assets. The USCIS site stated: "You may add the cash value of your assets. This includes money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, subtract your household income from the minimum income requirement (125% of the poverty level for your family size). You must prove the cash value of your assets is worth five times this difference (the amount left over)." So if you can borrow enough money to put in your bank account to show it in bank statement then you are fine. Also you can add your husband's asset for sponsoring.

thank you very much i really had no clue where to start with that i only wish there was a letter someone else has made in order to see an example of what format to send it. My brother military will be co sponsor and myself hopefully that is all i would need .

thank you that really helped me out with this i'm going to do the letter now just doing an I-864 myself and an I-864 A for my brother now just wondering if his wife will have to file I-864A because they both joint file taxes this passed year!... but not the other years they have a daughter so there are 3 household members(; you could help me out with this last question i would be really appreciative thanks!!!

As far as your brother's wife, it's depend on your brother's IRS tax transcript. Since you say the most recent tax he did was joint filed, then his wife will also need a I-864a. Because when he sending the that tax transcript as proof of income, NVC will see his wife's income as part of the transcript. Even if he send last three years transcripts and only one of them is joint filed, his wife still have to send I-864a for just that year. Yes, your brother's daughter is going to have some effect on his I-864 since he has to claim her. But like I mentioned before don't forget about other asset you all can put on the I-864. Bank account, stock, car, house etc whatever you guys owned. Good luck and hope that helps.

it really does this changes everything I already have the attachment letter for the I-864 and now i will have to find a new co sponser thank you
