Hi,

I need some help on completing I 864 for my parents.

My Dad's I 864 was accepted.

On my Dad's I 864 Part 2 it states he is the principal immigrant, Part 3 # 1, I answered yes and Part 3 #2 box was checked, I listed my Mom on 2a. as Family Member 1, as his spouse. Part 3, #7 the total number was 1.

Problem:

My Mom's I 864 gets returned with a request to correct.

Problem is stated as Part 3, Items 2 - 6F. Stating this case's visa category does not allow accompanying family members; therefore, you cannot list family members in this section.

On my Mom's I 864

Part 2, 1a, she is listed as the principal immigrant, Considered correct.

In Part 3 #1, I answered yes. Also considered correct.

For Part 3 #2, I did not check the box. And, in Part 3 2.a., I did not list my Dad as Family Member # 1.

On Part 3 # 7 the total number was 1 for both I 864. Both parents will arrive together.

Questions:

Should Part 3 #2 box be checked?

Should I have listed on Part 3, 2a. my Dad as Family Member 1 on my Mom's I 864?

After I get this corrected, I should be OK. Thank you in advance for your assistance.

My Mom and Dad have separate I 130 numbers.

All documents are completed and OK except for the completion of Mom's AOS. My Dad's AOS was accepted.

My Mom's needs to have Part 3. Q #2 AND Part 3. Q #2 a. answered correctly

It reads: I am sponsoring the following family members immigrating at the same time or within 6 months of principal immigrant name in part 2. (which is my Mom) so I think the box should be checked.

It further reads: Do not include any relative listed on a separate visa petition (which my Dad has his own petition and AOS).

This is where I am confused as the question cancels each others response.

I need to know if Family member 1 should list my Mom's name and Info OR my Dad's? I think it should be my Dad's Info (since my Mom is now the principal immigrant or her AOS).

My Mom's AOS keeps coming back to be corrected and it is always the same area of questions.

Would someone please confirm this.

Would someone please help?

We called last month and followed their instructions to a "T" and it was returned once more (third time) with problem area. Time is being wasted on this what appears to be simple issue.

Part 3 # 2 (which is just check or do not check the box * we were told not to check the box AND 2a - 6 where we were told not to write Dad as Family Member 1 on Mom's I 864..

We did just as they said and it was returned with error to correct! At the time they told us to not check Part 3 # 2 and not to include my Dad as Family member 1 on my Mom's I 864.

Dad's was accepted adding my Mom as Member #1 and checking Part 3 #1 box YES and #2 box stating I am sponsoring the following family members... listing my Mom .... .

So what is wrong? I do not want to wait a 4th month.

USCIS stage

sent i130 for my parents on april1, 2013

noa 1 on april 5, 2013

transferred from NBC to TSC on nov 18, 2013.

waiting waiting and hoping NO RFE.......

jan 31, 2014 NOA 2 ....

finally i 130 journey is approved ...

NVC stage

02/26/2014 nvc received my approved i130 from uscis

04/01/2014 case number and invoiced assigned

04/02/2014 AOS fee paid

04/04/2014 iv fee invoiced. not able to pay yet

04/06/2014 iv fee ok to pay, still in process

04/04/2014 AOS package sent via usps express mail. but weekends hummmmm

04/07/2014 AOS package arrived to NVC ( according to USPS tracking).

04/08/2014 officer lady from NVC said that my AOS packages are received .

04/09/2014 DS 260 completed. make some name mistake. hope it will not delay my case.

04/16/2006 IV package for parents are delivered to NVC ( according to USPS tracking).

04/21/2014 nice lady from NVC confirm that they received my IV package today. .

04/24/2014 nice lady from NVC confirm that they already accepted my AOS packages for both parents...

05/06/2014 one gentleman told me my case was completed already. (L) (L) (L)

06/11/2014 interview for my parents.

Hi

We called their 800 # and followed their directions for our situation. This was submitted as per instruction and a requested followed weeks later to request correction again as per emails above.

Then after a while of wondering what to do, wondering what did we do wrong, we got an email stating all documents have been received with our interview date and time.

Two corrected AOF were submitted. So I suggest to call them and have them direct you as per your situation. Don't forget to include the most recent tax return for the interview.

Good news - we did our medical, had our interview and were approved that day.
