So, are you suggesting they lie on the I-134? I do not think you should advise anyone to lie on any immigration form.

OP> You have to answer #7 of the I-134 which asks about your employment. If you are not employed when you fill out the form, then you need put that you are unemployed and use a co-sponsor.

I didn't ask them to lie, I said to not volunteer it if it's not asked. So, if the form did ask then they will need to put it down. If it's not asked then simply ignore it. Is that lying too?

Their interview is 2 months away. She has not provided the I-134 yet. You told her it was "No problem." and to just give her income info from the job she had last year, and not tell them she is unemployed with no current income. This is bad advice because of course the I-134 asks about your employment. So yes, you were telling them to lie. How could it not be asked when employment/financial info is asked right there on the affidavit of support form? You also could not possibly know if it would be "No problem." at the K-1 interview. What if the CO wanted to see a letter from employer or recent pay stubs and not just a tax return? What if the beneficiary was asked about their fiancee's current employment? It is a question that does come up at interviews. They ask about the USC petitioner's job, what they do, where they work, and things of that nature. They would not have been prepared for such a thing if they just decided it was "No problem."

OP> Glad you have a co-sponsor that you can use. A co-sponsor when unemployed is your best bet.

that is the point that i am scared because according with everything i have read in this forum on experienced people that questions always come. and also about the letter from work and pay stubs, now my brother is the co-sponsor, do i need his letter from his work and his pay stubs? i lost my job on the 19 two days ago but one month ago i sent the DS-160 FORM and my last job and position is typed already there, what i have to say on that position?

im feeling very depressed. cry.gif

thanks

Doesn't the DS-160 only ask for the occupation of the USC petitioner? If asked about your job, your fiance can just be honest and state that you just recently lost your job. Knowing what you did and where you worked is the important part, if asked. They would be asking to know if your relationship is real because that is something you would know about your fiance(e).

Yes, the co-sponsor provides their own separate I-134, most recent tax return, letter from employer and or most recent pay stubs. Also, they should provide proof of being a US citizen or permanent resident, in case it is needed.

yeah my fiance knows what is happening. he is very sad and worries.

if i got another job before, the co-sponsor doesn't have to provide letter, 1-134 for or pay stuff? just the affidavit?

thanks and Im sorry for all the questions.

If you are going to use a co-sponsor, then that is what a co-sponsor needs to supply, whether you have a job or not. They supply the I-134 and same supporting documentation as the USC petitioner does.
