Timeline

Getting a late start on filing our ROC's. Her GC exxpires 2/26/14

Part 1 16.a In care of name? What do I put there?

Part 3 6f Postal Code(6 e I already listed my zipcode)

Part 3 6.g Province?? I live in the USA

Part 4 info about your children

I have 3 kids from a previous marriage that I have custody of--do I list them here?

My wife and I have no children together and she has no children of her own.

I have all evidences, cover letter, lease, insurance, taxes, bank etc ready to go to the post office tomorrow morning.

To further stress me she has a trip planned back to Greece leaving on March 4th. So more questions: Biometrics how fast will that happen and if she's away can it be rescheduled? I know upon receipt her GC is extended 1 year, but will they give her a hard time if it arrives after her departure to Greece? Or can we make an info pass appt to get a stamp efre she leaves?

No, you don't have to list the children from previous marriage, as long as you are not petitioning for them also!

Not true. If this is a joint petition, which it is, ALL children have to be listed. There is a section where you list whether they are petitioning as well. List ALL children, even those that are "just" yours or "just" hers. Ignore the above advice!

Oh ok...I guess I received wrong info from USCIS. Had called them and they said we don't need to put my step kids on there!

I was confused of this too before I filed ROC. I called three separate times just to confirm about putting my USC daughter from my previous marriage on the 751.

I was told by on three separate phone calls, ONLY children of the alien removing conditions should be listed.

Yeah thats what they told me too!

We will see how that turns out then. We didn't put my step kids on there!

Even for AOS it say clearly, list your present spouse and all YOUR children, if you have none, write none.

i called, they said list only children you have together not step children. So that's what I did. Never received an RFE though we did have an interview.

During our interview, she asked while looking at the i485 if we had children, I said no. I have a daughter from previous marriage, should I have included her on the form. Her reply NO.

If it wasn't for the last minute, nothing would ever get done.

Well good luck man and get that thing in quick. I sent in my wife's ROC application in December, it looks like a 6 month wait.

You only need to list children if they are dependent children with an alien number.

I think it's pretty clear in the I-751 instructions on page one, under 'Who May File form I-751".

There is no mention of any children other than dependent children with an alien number.
