My fiancee lives in Philippines and I live in US. She was married before but her husband died. Her cenomar states that she is still married although she is widowed. I am filling out the I-129f to submit. Do I need to prove that she is widowed with the initial I-129f or do I just report her as a widow? Do i need A death certificate? An official statement of widow status from Philippines? Both? I imagine that her cenomar stating that she is married would cause problems. Many thanks in advance.

Do I need to include a death certificate for her husband (or something similar) with my I-129f then? Or does she need to prove that to the Phili consulates? Or both? She seems to think we can just check the widowed box and be fine but I am highly skeptical that that would do. Again, thanks very much in advance!

The USCIS usually accepts that she is widowed when you simply check that box. However, to play it safe, you also should submit his NSO death certificate. It would be a good idea to also include her NSO annotated marriage certificate to show that she was widowed.

At her Embassy interview, she almost certainly will be asked to submit an NSO death certificate. Make sure that it's a death certificate, because the Embassy won't accept a presumptive death certificate. She will also need to submit an NSO CEMAR (because she was married before).

Did your fiancee have the death certificate recorded at NSO ? This needs to be done so that her CENOMAR/CEMAR can be updated. The annotated CENOMAR will be needed at interview time later.

As for filing the I-129f, you need to include a copy of the death certificate. Read item 7 of the I-129F instructions regarding this.

Thanks for the responses guys. Sorry for the late rely but I only just figured out how to reply on my thread here.

I had downloaded an d saved so manyat least ifferent webpages and instructions that I forgot what I did with the original 129f instruction. Anyway, it took at least 2 weeks but we finally managed to get an official death certificate (from another country). Sent the I129f (with death certificate) to uscis in 3/24/14.
