I'm Canadian and my boyfriend is American, weve known each other for about a year and have been dating for about 9 months now. I'm currently staying at his place with his family under 'visiting' rights. I've been back and forth and I'm getting close to the four month mark of 180 days per 365 days. I'm looking over the K2 visa process because we do want to get married and I know the process may take a while, but I'm confused whether or not I'm allowed to stay as a visitor during the process or if I have to go back home and wait. We plan on getting married right away when we get my K2, and I pretty much have all the information needed, photos and even saved skype chats/calls, airplane tickets, reciepts, etc.

So yeah, I basically want to know if its okay to apply while im still visiting in the states, and if its okay to stay during the process because I have seen posts saying its okay. I just dont want to get in trouble for over staying my visit. Thanks in advance and sorry for writing such a jumbled up post/spelling grammar mistakes because I'm posting this from my phone.

K1 visa process is for a fiancé, the K2 is for the child of a fiancé

Yes, you may visit during the process and you can file while you are in the US. Just be careful not to overstay your authorized stay.

good luck

Yes, you can file while visiting. There is a section on the I-129F to fill out if you are currently in the US when the petition is filed. After the petition is approved, you will be applying for a K-1 visa at the consulate in your country. A K-2 is a derivative visa of the K-1 for children of those granted a K-1 visa.
