I met a woman on a dating website who lives in the Ukraine. She has a child also. We have not met in person yet, but she has a strong desire to move to the United States with her daughter to live with me.

I can't apply for a K-1 Visa yet and I can't go to visit her in the Ukraine until at least October.

Could she easily apply for a Tourist Visa for her and her daughter? I've heard that for single Ukrainian women, it is often difficult for them to get a Tourist Visa.

Please advise.

She could very easily apply for a tourist visa for her and her daughter.

Her chances of it getting approved and pretty much null, however.

She would need to prove strong ties that would prove to the consulate that she will return to Ukraine. Examples of these strong ties can be found elsewhere on this site as well as the embassy site. The facts that her motivation for travel to the US is to meet you rather than see Niagara falls, go shopping, etc will hurt since too many people enter on the B1, marry and then file to Adjust Status and remain.

B1 is a Business Visa.

If she does not apply chance is zero.

Well our plan was to have her visit me and since my business is at my home, for her to see if she would enjoy working with me and also having her daughter and her see how I live and if it would be acceptable enough for me to hopefully start a K-1 Visa maybe at the end of this year.

So, first off I'm not sure if a B-1 Visa would work or if she would want to only apply for a B-2 Visa. Any thoughts?

I can't travel to the Ukraine to meet her until probably the end of the year. And, I may be able to start an application for a K-1 Visa at the end of the year, but that is up in the air right now.

I've also thought of maybe using my business and applying for a Work Visa for her and then a Visa for her daughter with the work visa. It is an at home business though, with me as the owner/only employee so I don't know if that would work.

We have never met in person and I really would like her to see how I live before I would even start a K-1 Visa with her.

She has traveled some in Europe. Would that increase her chances to get a B-1 or a B-2 Visa?

she cannot work alongside of you with a B1 visa...that is a business visa, for meetings, certain pre-defined activities, not to sit down and work 'to see if she likes it.' The same requirements exist for obtaining a B1 visa; namely, that the CO is convinced she will return to her own country....something that appears to not be too likely.

You need to slow your roll. You're being grossly misinformed at best, looking to commit visa fraud at worst.

You're trying to be a little too clever and play semantics with the titles of the visas. It's not going to work out well for you. USCIS has been there, done that may times already. "My business in in my home so she should be allowed on a business visa!" Nope. You would need to PROVE the legitimacy of the following:

B-1 Temporary Business Visitor

You may be eligible for a B-1 visa if you will be participating in business activities of a commercial or professional nature in the United States, including, but not limited to:

  • Consulting with business associates
  • Traveling for a scientific, educational, professional or business convention, or a conference on specific dates
  • Settling an estate
  • Negotiating a contract
  • Participating in short-term training
  • Transiting through the United States: certain persons may transit the United States with a B-1 visa
  • Deadheading: certain air crewmen may enter the United States as deadhead crew with a B-1 visa
Eligibility Criteria

You must demonstrate the following in order to be eligible to obtain a B-1 visa:

  • The purpose of your trip is to enter the United States for business of a legitimate nature
  • You plan to remain for a specific limited period of time
  • You have the funds to cover the expenses of the trip and your stay in the United States
  • You have a residence outside the United States in which you have no intention of abandoning, as well as other binding ties which will ensure your return abroad at the end of the visit
  • You are otherwise admissible to the United States

As far as your H1B Work Visa plan, good luck with that. She also would not be able to come here on that until at least 2015.

2014 for H1b.

H1b's are handled by Immigration Lawyers, so that would be your first stop. Does your business have an Immigration Lawyer on retainer?

She can pursue a B1/B2 visa to visit you.

She cannot "help" you or "try out" if she likes to work with you because she would not be allowed to work in any capacity on a B1/B2 visa.

Unfortunately, work visas do not work the way you think. The US doesn't let US employers simply bring over a foreign worker when there's an American who can use the job. You need to prove you can't find a US person to do the job, then you need a Dept. of Labor certification, and then you apply for the work visa. The employee has to have a Unicersity degree related to the work. h1-b visas are limited and the annual allotment goes pretty quick. The process cost about $5000.

Save your money for the trip to see her. This is most likely what will happen.
