I'm Canadian and my Fiancee is American, we are just about ready to mail out our I-129 package. Do we have to submit both of our birth certicicates AND both of our criminal record checks ? Does my American Fiancee need to have a record of a Criminal Record Check put in the package ? Neither one of us has a Criminal Record of any sorts ....

Are you talking about a police certificate? You won't need that until the interview stage, and the beneficiary is the only one who will need to have one.

Criminal report of beneficiary will be given at the interview. The petitioners background check is done when you submit your application.

1.Do we have to submit both of our birth certicicates AND both of our criminal record checks ? You only need to include a long-form copy of your American fiance's birth certificate to prove US citizenship in the I-129F package. Alternatively, all pages of his passport. The beneficiary's birth certificate will be requested at the interview.

2. Does my American Fiancee need to have a record of a Criminal Record Check put in the package ? Neither one of us has a Criminal Record of any sorts .... No, he doesn't need to request his own criminal background check, it will be done by USCIS. The beneficiary's police record will be requested at the interview as well (i.e. no need to include it in the I-129F package).

And if the beneficiary has lived in any other country (besides the US) for more than 6 months, they need a police cert from there as well, which will be brought to the interview.
