Hello everyone my name is Che... I'm here right now in the USA with my US Citizen husband and our baby girl.. I am also pregnant now, and I'm planning to have my second baby in the Philippines.. But I don't how it will work because my conditional permanent residence for 2 years will expire on February 2015. And 90 days prior of the expiration of my Residency here I have to file some paper to change my status I think it's I-751.. So it will start on November to February. Also like what I said if I had the baby in the Philippines it will be on first week of October...

My Big question is....

1. Is my baby will be automatic US Citizen??? Since his/her dad is a US Citizen already...

2. How long to process all the paper of my baby to bring back in the USA?

3. What am I suppose to do?

Piece of advice, have your baby in the US. I went home to the Philippines to have my baby and I'm regretting the decision because it's such a hassle with the requirements and procedures and documents.

Answers to your questions:

1. You'll need to file a CRBA with the USEM for your child to gain citizenship

2. The entire process will largely depend on how long it takes to file the baby's birth with NSO. It can take up to 6 months from registering with the civil registry and getting your NSO birth cert which is a requirement for the CRBA and for Phil passport

3. Check the USEM website for the instructions for getting a CRBA, it's pretty detailed there. There is also a guide here but I can't find the link on my bookmarks. I know someone will post it here.

If you are planning to take the child back to U.S. Why not have the child in America. If u have the child in your country then ur USC husband can apply for crba.

That's a lot of work why not Having a baby In the U.S save hassle save $ no time will be wasted

No. However if the USC meets the physical presence requirements you are able to file a CRBA.

2. How long to process all the paper of my baby to bring back in the USA?

If you have all the paperwork ready, you can have the CRBA completed in less than 30 minutes at the embassy. How long you receive these papers, will depend on your country.

3. What am I suppose to do?

Have the Baby in the US.

If you don't get back within 6-12 months you might also loose your green card. You have to be in the US to remove conditions!

It's amazing how many questions can be resolved with a 2 minute Google search...

Hi Che I thought I'd share my experience with you. When my daughter was born in the Philippines in 2005, we requested an express NSO certified birth certificate right after I gave birth. It was a 30 day process but I'm assuming it'l' be quicker now. After that, my US Citizen husband called the US embassy and they told us that we needed to file a report for birth abroad. We went to the US embassy in Manila and filed the report for birth abroad and applied for US passport. The total time process wwas about a month and half. Hope this help. :)
