Well I am getting ready to submit removal of conditions and so far this is all what we have. I am a bit concerned we don't have enough evidence. Please let me know what you think.

  1. lease agreement with both of our names
  2. Costco membership cards
  3. 2012 tax return filed married together
  4. health insurance cards (he is under my health insurance)

Hello!

You will need a lot more than that. When are you filing?

1) Get a tax transcript from the IRS. It's free and has more information than your return and less pages too. You will need two years. If the second year won't be filed until after you submit your ROC application get that as well because you may be requested to submit those as an RFE (I've seen a lot of people in this situation).

2) Financial statements are important - credit card bills with both your names on it (if possible, or have one as authorized user), bank statements showing activity for at least 2 years, bills you pay for each other or together etc.

3) Any medical release forms signed to have each other as authorized recipient?

4) Benefits with each other listed as beneficiaries.

5) Any properties you own? Or car insurance?

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Hello,

I just want to post here what I had submitted initially which got me an RFE and what got me approved after the RFE. Hopefully this will help others going on this journey. You can also reference my signature regarding my timeline. My AOS (from H1-B to Condtional GC) was pretty quick and easy so this time around was a bit of a pulling-teeth experience.

My second response may seem like overkill to some but I would suggest doing that the first time around. There is no such thing as "too much evidence". One will never know what your adjudicator will be looking for. Some people may say certain evidences are not necessary but I personally would say go for it - if you can get it, send it and don't let inconveniences stop you.

Finally, regarding how I submitted my package. I can't remember how I submitted the first time but this is how I did it for the RFE.

1) I didn't staple the papers. I categorized my evidences into exhibits, paper-clip the exhibits together as one group and used sticky notes as tabs.

2) I created a cover sheet like a table of contents and put in my A#, my receipt number and then me and my husband signed it.

3) I use a large binder clip to hold them all together and find a big enough manila envelope and stuff the whole thing inside.

4) I mailed overnight via USPS with tracking and signature confirmation. It's costly but I must know it was received properly.

This is what I had submitted originally and it covers only the 2 years of my Conditional GC:

- Health insurance cards with both our names

- Joint bank statements for 2 banks (copies of once every 6 months - probably wasn't enough)

- Copies of credit cards with the same number but each under our own name - me being the authorized user

- My husband's credit card bills to our shared address

- 2 years worth of tax transcripts from IRS showing us filed jointly

- Car title with both our names plus latest car insurance info (my car)

- Airtickets and trip photos throughout the 2 years

My RFE didn't specifically request what I was missing. It was all boiler plate stuff - something along the lines of evidences need to include proof of co-habitation, financial comingling for the duration of the marriage etc. My guess was I didn't show solid proof of cohabitation and not enough financial statements. But I do know that other people's RFEs had been more detailed.

Here is what I had responded the RFE with - this time I covered everything from the day we got married (which was about 10 months before my conditional GC is valid):

- Proof of joint-residency including the lease that i didn't include in the first place and the documents for the new house we purchased after we submitted the initial application (utility bills, mortgage bill, deed)

- Health insurance claims with both our names

- My HIPAA release forms listing my husband's name

- The entire 2 years worth (every single month I can possibly get) of bank statements for 3 joint accounts plus letters from the bank stating our joint account status

- My husband's various paychecks (he was holding various part time jobs for most of the 2 years) to the same addresses we shared

- Our employment documents showing emergency contacts for each other plus current address and current employment status

- Updated car insurance cards and DMV registrations with both our names on it (mine and his car) - we updated his car info as well to add me as joint owner

- Affidavits from 3 friends and family members

- Photos of our latest trip together

ROC Journey:

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

Unfortunately he is only under my medical and dental insurance. I don't think we will be able to file our 2013 taxes because his GC expires on 3/28.

After you sent the ROC package, his GC is gonna extend for one year along with NOA1. You can still file taxes for 2013.

Might not be a bad idea to add each other on a bank or credit card account now. You don't have to add each other on everything that you own but use one that both of you commonly use.

It might be a bit late to do this but it may show an effort to prove that you have no issues adding each other to a financial account. Financials are one of the biggest things they look for. I submitted copies of our semi-annual joint bank statements and I believe that was one of the reasons why I got the RFE. So in my response I printed out every single month of all of our joint bank accounts - minus the ones I already submitted - spanning the entire duration of our marriage.

So if providing financial evidences is an issue you may have to consider other forms of solid evidences. Think long and hard what you may have but haven't considered in the beginning.

If you are truly lacking in evidences things like notarized affidavits, photos, trip passes (e.g. boarding pass, train tickets etc) and such, though considered "weak" evidences, can be thrown in as well. I did.

Give yourself some more time if you need to. You are not required to submit at 90 days prior to expiration.

And ditto to the 1 year extension from the last post. USCIS is obligated to provide a response to you within the 1-year extension - though not necessarily shorter than that. So please keep that in mind.
