Hi if theres anyone here who knows the idea about renewal of passport for a divorced filipina in the US but still have not recognized the divorce in court in the Philippines.

Ive read so much about those people who is renewing there passport but have not found same as my situation.

I found this requirements at the http://www.philippineembassy-usa.org/

REQUIREMENTS:

  1. Duly-accomplished passport application form, typed or printed legibly in black or blue ink
  2. Latest passport
  3. One (1) photocopy of each of the data page/s of the passport; i.e. pages 1-3 for the brown passport or page 1 for the green passport
  4. Photocopy of any valid identification card where the middle name is fully spelled out, such as state ID, driver’s license, Birth Certificate, Marriage Certificate, or Baptismal Certificate, if applicant’s last passport is the brown one.
  5. Proof that applicant has not applied for foreign citizenship, e.g. resident alien card (green card)
  6. Self-addressed return envelope, with appropriate stamps for express or priority mail with tracking numbers via US Postal Service, or with pre-paid mailing envelope from private courier of choice, if Passport is to be mailed back.
  7. Passport fee of $60.00 (non-refundable), payable in cash, or money order, bank draft, certified check or cashier’s check, made payable to "Embassy of the Philippines" (or "Philippine Consulate General", if application is made at one of the Philippine Consulates General in the U.S.). Personal checks and credit cards are not accepted.

Im really confused on the 5th one

will they allow me to renew my passport?

I just wanna renew, no last name change, just renew..

I can only offer what happened when my gal renewed her passport. Her existing passport at that time was in her maiden name. The only way she could renew her passport and have it in her married name was to file the "Report of Marriage" which we did at the same time she was renewing her passport.

So, in your case, If you have not did the "Report of Marriage" with the Philippine embassy the only way you can renew your passport is in your maiden name. Also, having a GC is not the same as having a "foreign citizenship."

So, to answer your question, yes you will be allowed to renew your passport in your maiden name provided you have not filed the "Report of [foreign] Marriage" to a foreigner with the philiippine embassy.

As long as your american spouse filed for the divorce, they should grant you to change your name.

If not, they can just make a statement that (your married name) & your maiden name is one person but your passport will still be on your married name. No other way around it except to have your marriage anulled in the Philippines.

Yes they will allow you because you have not yet applied for naturalization. Just show them your green card if you already have one.

my wife and I have a similar situation. she has a 2 year green card with 1 year extension waiting for 10 year green card. she wants to visit her mom in the Philippines soon, but just realized her Philippine passport is going to expire in a few months. we also found out there is a consulate outreach thing at a Filipino festival In Tampa, Florida next week, and I managed to get her an appointment there in one day, after finding out about it. but they said they can only renew her passport in her maiden name, unless we can report our marriage and her name change to a completely different Philippine Consulate 1500 miles away in Chicago, simply because we lived in Kansas when we were married, three years ago. they acknowledge that we cannot possibly complete that in time. I went to the other consulate site and they want 4 copies of nearly everything we've done over the past 5 years including 4 copies of my passport which has already expired, and 2 originals (all we have) of our marriage certificate which doesn't show her new name anyway, and 2 copies of it as well. when we were moving down here I misplaced my expired passport, though I have copies of it, I don't know where I packed it, and suspect presenting copies of my expired passport will not help renew hers. even if we could satisfy the consulate in Chicago then they'd have to relay the info to the consulate in Washington and then to the outreach guys in Tampa in a couple of days. So it looks like all we can do is renew it in her maiden name. Is that legal, and is it a good idea when were trying to keep everything the same for USCIS. I've been told she can travel to the Philippines and back with only her green card. I don't know if that's true, or where to find out, but my wife doesn't want to lose her ability to own land in the Philippines, and would like to make sure she doesn't mess up unintentionally along the way to becoming a US citizen.

Traveling with green card alone, in and out of the country is not true, you can't travel anywhere without a passport. Green card is only a document that let's you come back to US.

I suggest that you guys renew her passport on her maiden name. Get a certified copy of your marriage certificate. If you guys are married in US and have a marriage certificate issued from US, then have that marriage certificate consularized (authenticated by Philippine consulate with ribbon).

I assume her green card is on her married name, so a maiden name passport + marriage certificate(proof of change of name), should satisfy the name inconsistency.

thanks Merkin and Regine. I just want to make sure my wife can travel to visit her mom and return and not create any problems with her papers. If renewing her passport in her maiden name is legal and ok, sounds good to me. I can renew mine any time, but hers could be a bit more difficult, and is more important at the moment.
