Defcualty in answering the i-485

am on K-1 visa, i got married on 20 decamber, my 90 days finshed 26 decamber

-Address- C/O

-A # (if any)

-Current USCIS Status

-In what status did you last enter? (Visitor, student, exchangealien, crewman, temporary worker, without inspection, etc.)

-Were you inspected by a U.S. Immigration Officer?

-Consulate Where Visa Was Issued

-B. List your present husband/wife, all of your sons and daughters (If you have none, write "none." If additional space is needed, use separate paper).

is that question means my wife kids, they rnt my kids, so how i answer this one?

plzzz help about that cuz am really confused!

well i have some specific questions on the i-864 if you have time. i've read stuff on vj till i'm crosseyed and i still can't figure out some of it.

it's a good thing if the k-1 was sent there, as mine was from nebraska. dunno about the aos papers.

here goes my dumb question on the i-864:

although some links here on vj say there is supposed to be a new form, the one i've found on both vj and the uscis website lists one that has already expired (09/30/06)

i'm presuming i'm stuck with that one. if otherwise, let me know.

now for the weird math........

part 3, # 8 i check yes and # 10 i put "01"

then on to part 5, #21 i put the number from #10 in 21a. (01)

21b - myself

21c - nessa (01)

21d - my daughter (01)

grand total in h is 4? :wacko:

oh and the example form on vj is different than the current one, that's why i'm soooo confused.

-A # (if any) I believe this should be on your visa

-Current USCIS StatusK1 visa holder

-Were you inspected by a U.S. Immigration Officer?Immigration is done at the airport upon arrival, so yes

Charles,

You do not count your spouse twice since she is already counted for in Part 3. Your household size should be 3 if it's just you, your wife and your daughter. You only check the spouse in Part 5 if you are not sponsoring your spouse (ie. child only etc.).

Are you sure? I did the EZ and was so much easier for me :)

That's what it says on the EZ form...

Who May Use Form I-864EZ?

You may use Form I-864EZ IF ALL the following conditions apply:

1.You are the person who filed or is filing the Form I-130,Petition for Alien Relative, for a relative being sponsored;

2.The relative you are sponsoring is the only person listed onthe Form I-130 petition;

3.The income you are using to qualify is based entirely onyour salary or pension and is shown on one or more FormsW-2 provided by your employer(s) or former employer(s).

Who May Not Use Form I-864EZ?

You must complete Form I-864 (and not Form I-864EZ) if any of the following conditions apply:

1. If the relative you are sponsoring is not the only person immigrating based upon the underlying visa petition;

ed.

2.You filed or are filing a Form I-140, Immigrant Petition for Alien Worker, for the immigrant you are sponsoring;

3. You are a joint sponsor;

4. You are a "substitute sponsor" filing because the originalI-130 petitioner is deceased.

Did you see the capitalized, underlined, words at Part 5 item 21. that say "DO NOT COUNT ANYONE TWICE" ? The detailed instructions for Part 5 say the same.....

as i understand it, an i-864ez is for those who filed an i-130 (k-3), nessa and i are a k-1, so we are ineligible to file the ez form.
