This is the reason my joint sponsor back down. And also my husband agree with what my joint sponsor said. I want to ask is it correct or not.

"(A) in which the sponsor agrees to provide support to maintain the sponsored alien at an annual income that is not less than 125 percent of the Federal poverty line during the period in which the affidavit is enforceable".

So they said goverment will take the rest my joint sponsor money if my husband's income less than 125 percent of federal poverty.

I need you guys help. Gbu

Not really true. The I-864 is a legally binding document and the co-sponsor does agree to be financially responsible for you, but this really only comes into play if you were to apply for government benefits. The government could then sue the co-sponsor for whatever money you received. Other than that the government will not "monitor" your husbands income or make the co-sponsor pay you if he makes less than the 125%. It's just an assurance that you won't become a public charge.

They will not take any money from the joint sponsor if your spouse's income is too low. All USC primary sponsors have income that is less than 125% if they are needing a joint sponsor in the first place.

If you receive means-tested public assistance of any kind, then the government can go after the sponsors to pay them back for what the government gave you. They will go after the primary sponsor first. If the primary sponsor can't/won't pay, then they can go after the joint sponsor to pay them back.
