Going to send in I-130 petition. I have a question.

Hi Everyone,

It's been a long time coming but finally my husband and I decided to apply for the I-130 visa. I'm American and he's Pakistani. I lived in Pakistan for over 2 years and we got married shortly after I arrived (lived with him there).

My question right now is: he was not born in Pakistan (he was born in the Middle East) but has a Pakistani birth certificate because his parents felt it was needed back then. I think Pakistan would not have allowed him to be a citizen if he wasn't born there. So, he was born in the foreign country and his family moved back to Pakistan when he was about 11 years old. Also, his ID had the wrong birth date - wrong month and year (1 month and 1 year off from the right ones).

Should we put the REAL city and country place as where he was born or leave Pakistan as his birth certificate states? And, same question about the date of birth, too. I'm very conflicted. I want to be as honest as possible but I don't really think he has proof he was born in that foreign country anyway. It's a mess and we need to decide this obviously before applying.

Canadian_wife, I have no idea if it can be fixed. The country was Qatar. My husband thinks there may be something somewhere that can prove he was born there but he's not sure. I do know it's not easy to get things like this taken care of in Pakistan.

I also have another question if anyone out there can help.

On the I-130 form question #15 asks about employment. I assume that's regarding the petitioner and not the beneficiary? Also, #16 asks about the relative ever being under immigration proceedings. Is this solely regarding US immigration or other countries?

I suggest you at least try to get this mess fixed before you file. Otherwise it could cause problems, such as the location of the beneficiaries birth type questions, how would one answer that question on the I130?

Yes. I guess his dad decided that that needed to be done to ensure that my husband be a Pakistani citizen. I think (at least back then) that Qatar didn't let children of foreigners who were born there to be citizens. It's a ridiculous mess.

If it's a fake birth certificate then you should absolutely not use it or include its information on any US government forms; using fraudulent documents to procure a visa could lead to a lifetime bar from the US.

do not complicate your case frd, just file the case with what official documents you have, my date of birth is not same as mentioned in my official papers and the embassy never asked me about my DOB.

I definitely don't want to lie to the USCIS. That would be seriously stupid, I think. You never know what they can find out.
