Need help on I-129F

Hi Everyone,

I am helping my brother on its I-129F, and have couple of questions:

A.Should the questions that does not apply to him or his fiance be left blank, or should he put N/A?

(On the example form the spaces are left blank)

B. On question 36.a. it asks for American Consulate where my brother's fiance will apply for the visa, however, she lives in Iran, which does not have an American Consulate. So should she still put Tehran, Iran, or should she choose a city outside of Tehran, like Dubai or Turkey?

A. We left blank where it was not for us, and we were putting ¨none¨ where they ask to state so.

B. You need to check which Consulate works with Iran (normally if embassy does not have physical embassy in the country, they give info which closest embassy is in charge of this specific country), But guys from Iran will better tell you what to put, so wait until someone reply for that issue.

[For question A]

I am surprised that this "blank", "none, or "N/A" question comes up periodically on this VJ site.

This is clearly stated in the I-129F instructions

Answer all questions fully and accurately. If an item is not applicable or the answer is "none", leave the space blank.

This tells me people are not reading the instruction thoroughly.

"blank", "none", or "N/A" is least of concern as I think they will accept any of those,

but it does point out the risk of people not reading other instructions thoroughly

which can trigger RFEs and/or unnecessary delays.

[For question B]

There is no specific instruction on what to do if local fiancee's country does not have US embassy or consulate office.

I am pretty sure it will be one of the nearby country, but I don't know if you can just pick one or designated one.

You might want to search VJ site for visa filings for Iran and also call USCIS directly and find out.

Getting this correct could make difference in not losing few weeks or months to get this corrected.

Did you follow the sample form for the I-129F?

I was following the instructions of USCIS when we were filling it in (cos did not knew that they had samples onVJ ), but now i've checked the I-129F and it is done exactly as USCIS want, all the info on VJ is usually very accurate!

But still there are region specific questions always (like how to write name correctly, foreign alphabet etc...zip codes etc), so you always better read a lot and check all the info in order not to make "stupid" mistakes.

Regarding Consulate, still I highly recommend to check which of the closest to Iran consulate accept people from Iran....I was working in that field and I know that if the country does not have Embassy/Consulate in specific region they always indicate where person from that region may obtain visa. Example is: Embasssy of Ukraine in Cuba assists people from Venezuela, Dominican Republic....so basically due to different factors (political situation in the region, economical etc.) countries prefer to make in charge of specific region the closest embassy. (I hope i explained you somehow how it works).
