Can someone help me out a sec? I'm gonna be applying for my SSN either tomorrow or Tuesday. I've printed out the document on the VJ guide (List of Lawful Aliens Eligible for SSN) and also an e-mail directly from the SSA saying "We can assign a Social Security number (SSN) to a non-citizen when he or she: (1) is admitted to the United States for permanent residence; "

However, on the SS-5 application form, it says "Legal Alien Allowed/Not allowed to work". Which one do I tick? On the instructions, it says that if you tick NOT allowed to work, you must provide proof as to why you need a SSN. On the List of Lawful Aliens however, ( https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530 ) it says next to the K-1 field "Legal alien allowed to work".

My fiance insists that this means a K-1 holder is a legal alien allowed to work in the eyes of the SSA, therefore I should tick that box, otherwise they'll give me grief. I had always thought I tick "not allowed to work" as a K-1 can't work until the EAD. Which one do I tick? And if it's "not allowed to work", what documents do I need to take to prove I need a SSN? I already have my passport w/ visa, I-94, other ID, etc.

Thanks

You should tick the one that says that you are allowed to work as in theory you have right to apply for ead even on k-1 visa. It will still says on the card that its "valid for work only with dhs authorisation"

It is not where I breathe but where I love that I live.

A K-1 is a legal alien allowed to work, per https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530

Legal alien allowed to work. You are allowed to work, with an SSN and the EAD or green card.

~ Moved from AOS from Family Based to Social Security Numbers - topic is about applying for SSN ~
