Ok,

Marlon has a 5 year old son who lives in England. Do we need to put his information on the initial paperwork? We are not going to file for him to join us until much later. Another message board advised me not to include his son at this time.

Advice please and thanks!

Whether you are including the son on the petition or not, you have to include his information wherever it's requested.

I'd list the child's name on the I-129f. a k-2 visa can be issued up to one year after the K-1 has been issued.

You should definitely list his son's name on your I-129F application.

You say in your post that you won't be filing for his son to join him until later. The K-2 Visa must be issued within 1 year of the K-1 Visa. That means that if the K-1 Visa is issued Jan 1, 2007, the K-2 Visa must be issued by Jan. 1, 2008. That means the Visa must be in hand, not just applied for by that time.

I received my K-1 Visa on June 10, 2004. I started the K-2 Visa process for my daughter in early 2005, and her K-2 Visa was issued May 26, 2005. I obtained her K-2 Visa within 2 weeks of my K-1 Visa's one-year anniversary.

You will want to allow plenty of time for processing of the K-2 Visa because, like I said previously, the K-2 Visa must be issued, not just in the process.

Good luck.

Thanks to everyone's responses! I will be sure to let Marlon know. Another question, will I need to submit a copy of his son's birth certificate with our I29 petition?

If you are not planning to apply for a K2 for the son, I don't think it is necessary to provide a birth certificate - just the information regarding the child's address and birthdate. Double check the I-129F instructions as it should clearly indicate if it is required or not. I know we did not send them for my fiance's children because we are not applying for K2s for them.

No, it is not required for the petition. The only information required is to list the child's name and address, etc...

YMMV
