Did not mention Social security in affidavit of support

Hi guys,

During the process of preparing for AOS, my husband got Social security benefits even though at the time he worked. He called social security to stop sending him money because he has a job. They asked him to fill in an application and send it by mail (which we did). What was supposed to happen is that my husband will return whatever he got from SS by mistake. When we filled the AOS affidavit of sponsorship, we didnt mention about getting money from SS since we thought this is a mistake and that my husband needs to return whatever SS sent him (because he works). Yesterday, months after not hearing from SS, my husband called them again to see what is going on. The woman on the phone told my husband that on the system she has nothing that says my husband got money by mistake or anything that shows that my husband needs to return money and since he got terminated (before filling AOS) he is eligible for SS. The thing is that He still got the money while working for ONE YEAR. He called and went to the office many times but they obviously want to keep giving him money lol.

My problem is that we didnt mention that on the affidavit thinking that the SS money will be returned and no other payments are going to be done. What to do now? should I call USCIS and tell them about this or should I explain that during the interview? an info-pass?

Im not sure how serious USCIS can look at this and We dont want to mess with the government for sure.

Any advice will be much appreciated.

You can work while receiving social security. Over a certain amount of income reduces your benefits. Are you sure you aren't talking about unemployment? Since you didn't use the income on the affidavit of support there is nothing to explain as far as I would think.

belinda63 : Yes he started getting unemployment but also he gets social security benefits (he used to get that while he was at college) and even when he graduated and got a job, they kept sending money to his bank account until now. During all this time, he contacted them and he didnt want to have to pay back 3000$ so he wanted them to stop but in vain. The problem is that even if he still can get Social security is that we did not mention that in his annual salary on the affidavit (thinking he will need to return all the money he got and that social security is doing it by mistake). I will call USCIS tomorrow and see what they say

Now I am curious, What are the social security benefits? Disability, survivor, what?

Disability-- my husband is hard of hearing.
