Hi All,

My Fiancee and I have applied for a K1 visa and we look on track to be married in May-2014.

We are trying to save as much money as possible before/after we're married, and was just wondering if there is a deadline to apply for "adjustment of status" after the marriage? We couldn't really afford $1000 straight after! It would just be helpful to wait 2 or 3 months before I do it (i.e. I find a job).

I waited three months to submit our AOS application after getting married. My EAD came through two months later. I hope this helps!

Timeline

You file for the EAD that allows you to work when you file for AOS. The current fee is $1070. There is no deadline to file, but you will be out of status when your I-94 expires and won't be able to work, get a license/state ID or travel outside the US and re-enter until after you file and have your EAD/AP or green card.

Just to emphasize this, you CANNOT work in the U.S. without an EAD. You will want to apply for the EAD along with your AOS application - the EAD won't cost you anything additional then, just the $1.070 for the actual AOS. I recommend starting to save up money now - you still have a couple of months left, and if you saved say $100,00 per month, you would probably have most of the cost together by the time you are applying. Listen to the advice,you cant work legally without the work permit,you will have to pay the $1070 like it or not,i know someone who was deported for working illegally in a relatives restaurant.Why not do what i did before i left England,for a year i took on a second weekend job to save up because i knew it would be a while before i could work,my fiance also worked extra hours and did a summer job at weekends too,could you not borrow money from relatives ? best of luck

Definitely wasn't going to work illegally. I thought I could apply and use my EAD when I got my K1 visa...only to find out after posting this topic that the EAD expires when the K1 expires! Think we will just pay the $1070 straight after the wedding.
