K2 unaccompanied minor using Advance Parole

Hello Vj family! My question is for my 16 yr old son who is going back to the Philippines to finish High School using EAD/AP combo card. He came here using K2 Visa on April 15, 2013 and I applied for our AOS last June 2013, and still waiting for its approval. Is he going to have a problem in the Immigration on his return to the US if he stays in the Philippines for 6 months or longer using only his EAD/AP combo card? And when we get approved, can i send his green card on mail in the Philippines? Please help me.. his flight is on the 4th of Dec....God Bless y'all

hello I have the same situation with my son, he came to US as k2 in 2012, but then he should finished his senior high school so he went back to the Philippines

but before he left I had to let his biometrics finished immediately before his departure, and applied his parole while he was in the Philippines, we had his Advance Parole processed here in US, then after 2 months we got it from uscis and sent it to my son for his re-entry coming back to US last April 2013. then after 3 weeks of his arrival he had an interview for his Green Card and he is now a GC holder. Look into getting a Re-Entry Permit.

A green card holder who leaves the US for longer than a year should get a Re-Entry Permit.

A green card holder who spends significant time outside the US is deemed to have abandoned their status if he/she does not have a Re-Entry Permit.

here's my info:

May 2012 son arrived in USA as K2

May 22, 2012 applied for AP (note did not apply for EAD as he was going back to school in PH)

June 1, 2012 Biometrics

June 8, 2012 received notice of interview for GC

June 11, 2012 cancelled the interview because he was in the Philippines for valid reason( finished HS)

June 1st week off to Philippines for SY 2012-2013

July 22, 2012 Got the Advance Parole

March 2012 sent the AP for his re-entry to USA

April 2103 Came back to USA

May 22, 2013 Interview for GC

June 12, 2013 Got his GC card

June 13, 2013 Applied for SSN

August 2013 enter college- Fall- in USA

Tnx Aaron for your reply but my son is not a green card holder yet, what he had right now is his EAD/AP combo card.He will be out of the US while waiting for the approval of AOS (green card) and For sure he will not be staying longer than 10 months in the Philippines.

HI wjethel, yah I agree with apple not good to send the GC that's a very important doc. you better send the AP for his re-entry. good luck again.
